  1. LICENSE AGREEMENT

  3. Any use of this software constitutes acceptance of this License Agreement.

  5. LinkMate and its accompanying documentation are copyrighted works and have
  6. been released for distribution as Shareware.  Non-registered users are 
  7. granted a limited license to evaluate this program, without cost, for a 
  8. period of thirty (30) days with limited technical support, after which 
  9. time the program must either be registered or removed from the system. 
  10.  
  11. Use of LinkMate beyond the 30 day evaluation period, without registering, 
  12. is expressly forbidden and is in violation of U.S. and International 
  13. Copyright Laws.
  14.  
  15. No person other than the author, Mike Davis, may accept payment or 
  16. royalties for this software.
  17.  
  18. Technical support is granted to non-registered users solely at the author's 
  19. discretion.

  21. THE AUTHOR DISCLAIMS ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER 
  22. EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES 
  23. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ALL SUCH 
  24. WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED. THIS SOFTWARE IS 
  25. PROVIDED "AS IS".  THE AUTHOR CLAIMS NO RESPONSIBILITY FOR ANY INDIRECT, 
  26. CONSEQUENTIAL OR INCIDENTAL DAMAGES OR UNDESIRABLE RESULTS ARISING OUT OF 
  27. THE USE, INABILITY TO USE, OR ABUSE OF THIS SOFTWARE EVEN IF THE AUTHOR 
  28. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.  IN NO 
  29. EVENT SHALL THE AUTHOR'S LIABILTY FOR DAMAGES EVER EXCEED THE PRICE PAID 
  30. FOR THE LICENSE TO USE THIS SOFTWARE, REGARDLESS OF THE FORM OF CLAIM.  
  31. THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE QUALITY AND 
  32. PERFORMANCE OF THE SOFTWARE.  THIS SOFTWARE REMAINS THE PROPERTY OF THE 
  33. AUTHOR AND MAY NOT BE MODIFIED BY THE USER IN ANY WAY.

  35. Some states do not allow the exclusion of the limit of liability for 
  36. consequential or incidental damages, so the above limitation may not 
  37. apply to you.

  39. This agreement shall be governed by the laws of the State of Ohio and 
  40. shall inure to the benefit of the author and any successors, 
  41. administrators, heirs and assigns.  Any action or proceeding brought 
  42. by either party against the other arising out of or related to this 
  43. agreement shall be brought only in court in Stark County, Ohio.  The 
  44. parties hereby consent to in personam jurisdiction of said courts.

  49. Registered versions of this software may be used by one person who is 
  50. using the software personally on one or more computers, or used 
  51. nonsimultaneously by multiple people who are using the software on a 
  52. single computer, but not both .  Use of LinkMate on a network requires 
  53. individual licenses for any and all workstations which have access to 
  54. LinkMate.  For example, if LinkMate can be accessed by 5 different 
  55. workstations on a network, each workstation must have its own license 
  56. for the software regardless of whether they use LinkMate at different 
  57. times or concurrently.

  59. Under no circumstances may the Registration Key be given to any 
  60. individuals, except to a  registered user directly from the author.

  62. Registering LinkMate entitles you to free upgrades, full technical 
  63. support, and will eliminate the Registration Notice from appearing at 
  64. various time throughout the software.
