  3. BEFORE PROCEEDING WITH THE INSTALLATION AND/OR USE OF THIS SOFTWARE, CAREFULLY
  4. READ THE FOLLOWING TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT AND LIMITED
  5. WARRANTY (The "Agreement").

  7. BY INSTALLING OR USING THIS SOFTWARE YOU INDICATE YOUR ACCEPTANCE OF THIS
  8. AGREEMENT. IF YOU DO NOT ACCEPT OR AGREE WITH THESE TERMS, YOU MAY NOT
  9. INSTALL OR USE THIS SOFTWARE!

  11. LICENSE

  13. This software, including documentation, source code, object code and/or
  14. additional materials (the "Software") is owned by microOLAP Technologies
  15. LLC (the Autor).
  16. This Agreement does not provide you with title or ownership of Product,
  17. but only a right of limited use as outlined in this license agreement.
  18. "System Pack Volume III: FILES" author hereby grant you a non-exclusive,
  19. royalty free license to use the Software as set forth below:
  20.  
  21.  . integrate the Software with your Applications, subject to the redistribution
  22.    terms below.
  23.  . modify or adapt the Software in whole or in part for the development of
  24.    Applications based on the Software.
  25.  
  26. REDISTRIBUTION RIGHTS
  27.  
  28. You are granted a non-exclusive, royalty-free right to reproduce and
  29. redistribute executable files created using the Software (the "Executable Code")
  30. in conjunction with software products that you develop and/or market
  31. (the "Applications"). 
  32.  
  33. RESTRICTIONS
  34.  
  35. Without the expressed, written consent of "System Pack Volume III: FILES"
  36. author, you may NOT:
  37.  
  38.  . distribute modified versions of the Software, in whole or in part.
  39.  . rent or lease the Software.
  40.  . sell any portion of the Software on its own, without integrating it
  41.    into your Applications as Executable Code.

  44. LIMITED WARRANTY

  46. THIS SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND EITHER EXPRESSED
  47. OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES MERCHANTIBILITY
  48. AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND 
  49. PERFORMANCE OF THE PRODUCT IS WITH YOU. SHOULD THE PRODUCT PROVE DEFECTIVE, YOU
  50. ASSUME THE COST OF ALL NECESSARY SERVICING OR ERROR CORRECTION.

  52. "System Pack Volume III: FILES" AUTHOR DO NOT WARRANT THAT THE FUNCTIONS
  53. CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF
  54. THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE.

  57. LIMITATION OF REMEDIES AND LIABILITY.

  59. IN NO EVENT SHALL "System Pack Volume III: FILES" AUTHOR, OR ANY OTHER PARTY
  60. WHO MAY HAVE DISTRIBUTED THE SOFTWARE AS PERMITTED ABOVE, BE LIABLE FOR DAMAGES,
  61. INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING
  62. OUT OF THE USE OR INABILITY TO USE THE SOFTWARE (INCLUDING BUT NOT LIMITED TO
  63. LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR
  64. THIRD PARTIES OR FAILURE OF THE SOFTWARE TO OPERATE WITH ANY OTHER PRODUCTS),
  65. EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  66. DAMAGES.
