  98. 'Software' or 'Program' means the ChaoSoft software product StepUp'98,
  99. including both the software and the associated documentation and other
  100. materials;
  101.  
  102. 'Evaluation Copy' means a copy of the Program you obtained from us or
  103. other source for evaluation purposes and which is described as
  104. "Unregistered" in the 'About' screen. An Evaluation Copy may be converted
  105. to the Licensed Copy by supplying a name of a registered user or
  106. institution and a correct Registration Code, which may be obtained from
  107. ChaoSoft or its authorized dealer(s).
  108.  
  109. 'Licensed Copy' means a copy of the Program registered with ChaoSoft or
  110. with its authorized dealer, and which is described as "Registered to:
  111. <user name>" in the 'About' screen. A Licensed Copy converts itself into
  112. an Evaluation Copy when it is copied to another disk or computer, or when
  113. the registration information is erased.

  115. 'Registration Package' means all the materials you are obtaining from us
  116. or our authorized dealer after sending us your registration fee. In
  117. particular, Registration Package contains your personal Registration
  118. Code, allowing you to remove the registration reminder message and put
  119. your name in the 'About' screen.

  121. 'we' or 'us' means ChaoSoft, a company produced this software
  122.

  125. 'you' means the end user or distributor of the Software.

  129. This is a legal agreement between you and ChaoSoft. By using or

  136. the terms of this agreement. The software is in "use" on a computer when

  141. The software is NOT a public domain or free program. It is owned by
  142. ChaoSoft and is protected by United States copyright laws and
  143. international treaty provisions. Therefore, you must treat the Software
  144. like any other copyrighted material except that a limited right to make

  146. is granted to you. You may not copy any written or printed materials
  147. from your Registration Package and you may not rent or lease a Licensed
  148. Copy of the Software.

  150. TRIAL USE LICENSE

  152. ChaoSoft grants to you a limited license to use an Evaluation Copy of
  153. this software for evaluation purposes for a period not to exceed 14 days.

  155. This period may be not a contiguous sequence of days. However, you should
  156. count a day as an evaluation day if you used the Program during that day
  157. at least once. The purpose of this evaluation period is to allow you to
  158. determine whether the program meets your needs before purchasing it.

  160. Once the evaluation period has ended, you MUST either purchase a license
  161. for continued use of the program, or stop using it.  Use of an Evaluation
  162. Copy beyond the end of the evaluation period without registering it is in
  163. violation of federal copyright laws.

  165. If you have sent out your registration fee, you may continue to use your
  166. Evaluation Copy beyond the end of the evaluation period until your
  167. Registration Package arrives.

  169. Obtaining a license for continued use of the Program.

  173. your name, address, and correct amount of registration fee to our

  175. documentation to the Software.  After getting your Registration Package,
  176. containing the Registration Code assigned to you, you may use that code
  177. to convert your Evaluation Copy of the Software into the Licensed one.

  179. You agree to keep the Registration Code for your own use only and
  180. not share it with anybody else.

  182. CONTINUED USE LICENSE

  184. ChaoSoft grants to you the right to use a Licensed Copy of the software,
  185. if you have registered (purchased a license for continued use) it with us
  186. or with our authorized dealer.

  188. You may install a Licensed Copy of the software on more than one computer
  189. (for example, a desktop system and a portable notebook), provided that
  190. you are the only user of those computers and there is no possibility to
  191. use the Licensed Copy by anybody else.

  193. You may not network a Licensed Copy or otherwise use it on more than one
  194. computer or computer terminal at the same time unless you have purchased
  195. a site license.

  197. If the Licensed Copy you are using is registered to some other name, you
  198. MUST either unregister it by removing the registration information, or
  199. stop using it. Use of a Licensed Copy, registered to anybody else except
  200. you (or, for site license arrangements, to your organization), is in
  201. violation of federal copyright laws.

  203. Multi-User and Network Use.

  205. If you have registered the Software for use by multiple users,  you agree
  206. not to use the Program on more computers than the number specified in
  207. your site license. You may install the Program on computers attached to a
  208. network, or remove it from one computer and install it on a different
  209. one, provided there is NO POSSIBILITY that your copy will be installed or
  210. used on more computers than it is licensed for.  If you have a network,
  211. you don't need to include every computer attached to the network in your
  212. license, but you must include every computer on which the Program is
  213. installed or used, regardless of whether the user of the computer happens
  214. to know that the Program is in use on their system.  If you have single
  215. computers which allow multiple users to use the Program simultaneously,
  216. you must count each keyboard or terminal separately when determining how
  217. many computers are using the Program.

  219. LIMITED DISTRIBUTION LICENSE

  269. LIMITED WARRANTY

  272. This warranty does NOT apply to Evaluation Copies of the Program.

  274. Satisfaction Guarantee.  If you are dissatisfied with any product you buy
  275. from us under this Agreement for any reason, you may return it at any
  276. time up to 30 days after purchase and we will give you a refund. Refunds
  277. will be based on the price you paid, with shipping costs excluded.  You
  278. must contact us before returning any product for a refund. This
  279. satisfaction guarantee does not apply to multi-system licenses for more
  280. than 10 computers, or to purchases of more than 10 individual copies at a
  281. time.

  283. Physical Defects.  We pledge that the disks, if any, and any printed
  284. material we send you will arrive free of physical defects which interfere
  285. with normal use. If you find such a defect and report it to us within 30
  286. days after you get your Registered Package, we agree to replace the
  287. defective item(s) at no charge to you as long as the defect was not
  288. caused by misuse or abuse.

  290. Bugs and Program Errors.  We don't promise that the Software will be free
  291. of bugs or program errors, and you agree that bugs or program errors will
  292. not be considered as "physical defects" in the program. We agree that if
  293. you report a program error or bug to us, we will use our best efforts to
