  1. MICROSOFT DEVELOPMENT LICENSE
  2. Microsoft WinG Software Development Kit
  3.  
  4. This is a legal agreement between you (either an individual or an 
  5. entity) and Microsoft Corporation ("Microsoft").  By accessing and 
  6. using the software, you are agreeing to be bound by the terms of 
  7. this Agreement.  If you do not agree to the terms of this Agreement, 
  8. you are not authorized to use the software.
  9.  
  10. MICROSOFT LICENSE AGREEMENT
  11.  
  12.     1.    GRANT OF LICENSE TO USE.  Microsoft Corporation 
  13. ("Microsoft") grants to you the non-exclusive right to use the 
  14. Microsoft software and electronic text files comprising the 
  15. documentation (the "SOFTWARE") on a single computer for the sole 
  16. purposes of designing, developing, and testing your software 
  17. product(s), including but not limited to Windows-based and Win32-
  18. based applications, and other software products, which operate in 
  19. the Microsoft Windows or Windows NT evironments.  Microsoft reserves 
  20. all rights not expressly granted.

  22.     2.    COPYRIGHT. The SOFTWARE is owned by Microsoft or its 
  23. suppliers and is protected by United States copyright laws and 
  24. international treaty provisions.  Therefore, you must treat the 
  25. SOFTWARE like any other copyrighted material (e.g., a book or 
  26. musical recording).  You may not use or copy the SOFTWARE for any 
  27. other purpose than what is described in this Agreement.  Except as 
  28. provided herein, Microsoft does not grant any express or implied 
  29. right to you to or under Microsoft patents, copyrights, trademarks, 
  30. or trade secret information.

  32.     3.    OTHER RESTRICTIONS. You may not rent or lease the 
  33. SOFTWARE, but you may transfer the SOFTWARE and accompanying written 
  34. materials on a permanent basis provided you retain no copies and the 
  35. recipient agrees to the terms of this Agreement.  If the SOFTWARE is 
  36. an update or has been updated, any transfer must include the most 
  37. recent update and all prior versions.  You may not reverse engineer, 
  38. decompile or disassemble the SOFTWARE except to the extent that the 
  39. foregoing restriction is expressly prohibited by applicable law.

  41.     4.    SAMPLE CODE. Microsoft grants you a non-exclusive 
  42. royalty-free right to use and modify the source code version of the 
  43. sample code located in the "samples" directories (Sample Code) for 
  44. the sole purposes of designing, developing and testing your software 
  45. products which operate in the Microsoft Windows or Windows NT 
  46. environments, and to reproduce and distribute the Sample Code along 
  47. with any modifications thereof, only in object code form provided 
  48. that you comply with Section 6.

  50.     5.     REDISTRIBUTABLE CODE.  In addition to the rights 
  51. granted in Section 1, Microsoft grants you additional rights to the 
  52. SOFTWARE designated as "Redistributable Code".  The Redistributable 
  53. Code files and the rights associated with each of them, subject to 
  54. Section 6, are: WING.DLL, WING32.DLL, WINGDE.DLL, WINGDIB.DRV, 
  55. WINGPAL.WND, SETUPHLP.DLL, and DVA.386

  57.     6.    DISTRIBUTION REQUIREMENTS.  If you are authorized to 
  58. redistribute the Sample Code and/or Redistributable Code, 
  59. (collectively "REDISTRIBUTABLE COMPONENTS") as described in Sections 
  60. 4 and 5 above, you must (a) distribute the REDISTRIBUTABLE 
  61. COMPONENTS only in conjunction with and as a part of your software 
  62. application product; (b) not permit further redistribution of the 
  63. REDISTRIBUTABLE COMPONENTS by your end-user customers; (c) not use 
  64. Microsoft's name, logo, or trademarks to market you software 
  65. application product; (e) include a valid copyright notice on your 
  66. software application product; and (d) agree to indemnify, hold 
  67. harmless, and defend Microsoft from and against any claims or 
  68. lawsuits, including attorney's fees, that arise or result from the 
  69. use or distribution of your software application product.  The 
  70. license in this section to distribute REDISTRIBUTABLE COMPONENTS is 
  71. royalty-free provided that your software application product is 
  72. designed, developed and tested for operation in the Microsoft 
  73. Windows or Windows NT environments.  Contact Microsoft for the 
  74. applicable royalties due and other licensing terms for all other 
  75. uses and/or distribution of the REDISTRIBUTABLE COMPONENTS.

  77.     7.    EXPORT RESTRICTIONS.  You agree that neither you nor 
  78. your customers intend to or will, directly or indirectly, export or 
  79. transmit (a) the SOFTWARE or related documentation and technical 
  80. data or (b) your software application product as described in 
  81. Section 6 of this Agreement (or any part thereof), or process, or 
  82. service that is the direct product of the SOFTWARE to any country to 
  83. which such export or transmission is restricted by any applicable 
  84. U.S. regulation or statute, without the prior written consent, if 
  85. required, of the Bureau of Export Administration of the U.S. 
  86. Department of Commerce, or such other governmental entity as may 
  87. have jurisdiction over such export or transmission.
  88. LIMITED WARRANTY
  89.  
  90. NO WARRANTIES.  To the maximum extent permitted by applicable law, 
  91. Microsoft expressly disclaims any warranty for the SOFTWARE.  The 
  92. SOFTWARE and any related documentation is provided "as is" without 
  93. warranty of any kind, either express or implied, including, without 
  94. limitation, the implied warranties or merchantability or fitness for 
  95. a particular purpose.  The entire risk arising out of use or 
  96. performance of the SOFTWARE remains with you. 
  97.  
  98. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  To the maximum extent 
  99. permitted by applicable law, in no event shall Microsoft or its 
  100. suppliers be liable for any damages whatsoever (including, without 
  101. limitation, damages for loss of business profit, business 
  102. interruption, loss of business information, or any other pecuniary 
  103. loss) arising out of the use or inability to use this Microsoft 
  104. product, even if Microsoft has been advised of the possibility of 
  105. such damages.  Because some states/jurisdictions do not allow the 
  106. exclusion or limitation of liability for consequential or incidental 
  107. damages, the above limitation may not apply to you.

  109. U.S. GOVERNMENT RESTRICTED RIGHTS.
  110.  
  111. The SOFTWARE and documentation are provided with RESTRICTED RIGHTS.  
  112. Use, duplication, or disclosure by the Government is subject to 
  113. restrictions as set forth in subparagraph (c)(1)(ii) of The Rights 
  114. in Technical Data and Computer Software clause at DFARS 252.227-7013 
  115. or subparagraphs (c)(1) and (2) of the Commercial Computer Software 
  116. -- Restricted Rights at 48 CFR 52.227-19, as applicable.  
  117. Manufacturer is Microsoft Corporation/One Microsoft Way/Redmond, WA 
  118. 98052-6399.

  120. If you acquired this product in the United States, this Agreement is 
  121. governed by the laws of the State of Washington.  If you acquired 
  122. this product outside the United States, local law may apply.
