  4. LICENSE STATEMENT 
  5. AND LIMITED WARRANTY
  6.  
  7. IMPORTANT - READ CAREFULLY
  8. This License Statement and Limited Warranty constitutes a legal agreement 
  9. ("License Agreement") between you (either as an individual or a single 
  10. entity) and FormFeed Software ("FormFeed") for the software product ("Software") 
  11. identified above, including any software, media, and 
  12. accompanying on-line or printed documentation.
  13.  
  14. BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE 
  15. BOUND BY ALL OF THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.  If you 
  16. are the original purchaser of the Software and you do not agree with the 
  17. terms and conditions of the License Agreement, promptly return the unused 
  18. Software to the place from which you obtained it for a full refund.
  19.  
  20. Upon your acceptance of the terms and conditions of the License Agreement, 
  21. FormFeed grants you the right to use the Software in the manner provided 
  22. below.
  23.  
  24. This Software is owned by FormFeed or its suppliers and is protected by 
  25. copyright law and international copyright treaty.  Therefore, you must 
  26. treat this Software like any other copyrighted material (e.g., a book), 
  27. except that you may either make one copy of the Software solely for backup 
  28. or archival purposes or transfer the Software to a single hard disk 
  29. provided you keep the original solely for backup or archival purposes.  
  30.  
  31. Except as provided in this License Agreement, you may not transfer, rent, 
  32. lease, lend, copy, modify, translate, sublicense, time-share or 
  33. electronically transmit or receive the Software, media or documentation.  
  34. You acknowledge that the Software in source code form remains a 
  35. confidential trade secret of FormFeed or its suppliers and therefore you 
  36. agree not to modify the Software or attempt to decipher, decompile, 
  37. disassemble or reverse engineer the Software, except to the extent 
  38. applicable laws specifically prohibit such restriction. 
  39.  
  40. If you purchased this Software as an upgrade, it constitutes a single 
  41. product together with the product that you upgraded, and may not be used 
  42. to increase the total number of licensed copies of the Software.  You may 
  43. use the upgraded product only in accordance with this License Agreement 
  44. and you may not transfer this Software or the product you upgraded unless 
  45. they are transferred together as a single product.

  47. ADDITIONAL TERMS WHICH APPLY TO THE EVALUATION PERIOD
  48. If you have obtained permission from FormFeed to evaluate the Software, 
  49. you may install the Software on a temporary basis for evaluation purposes 
  50. only.  The evaluation period is limited to 15 days from the date the 
  51. Software is installed ("Evaluation Period").  After the Evaluation Period 
  52. your license to use the Software will expire.
  53.  
  54. THE SOFTWARE CONTAINS A TIME-OUT FEATURE THAT DISABLES ITS OPERATION AFTER 
  55. THE EXPIRATION OF THE EVALUATION PERIOD.  
  56.  
  57. DURING THE EVALUATION PERIOD, THE SOFTWARE IS PROVIDED ON AN "AS IS" BASIS 
  58. "WITH ALL FAULTS."  YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND 
  59. PERFORMANCE OF THE SOFTWARE DURING THE EVALUATION PERIOD.  SHOULD THE 
  60. SOFTWARE PROVE DEFECTIVE DURING THE EVALUATION PERIOD, YOU, AND NOT 
  61. FORMFEED OR ITS SUPPLIERS, ASSUME THE ENTIRE COST OF ALL NECESSARY 
  62. SERVICING AND REPAIR. 
  63.  
  64. In order to use the Software after the Evaluation Period, you must 
  65. register the Software with FormFeed. If you decide not to register 
  66. the Software, you agree to destroy or permanently delete the Software from 
  67. your computer upon expiration of the Evaluation Period, and not to 
  68. reinstall a new copy of the Software.
  69.  
  70. LIMITED WARRANTY
  71. FormFeed warrants that the Software, as updated and when properly used, 
  72. will perform substantially in accordance with its accompanying 
  73. documentation, and the Software media will be free from defects in 
  74. materials and workmanship, for a period of ninety (90) days from the date 
  75. of receipt.  Any implied warranties on the Software are limited to ninety 
  76. (90) days.  Some states or jurisdictions do not allow limitations on 
  77. duration of an implied warranty, so the above limitation may not apply to 
  78. you.

  80. FormFeed's and its suppliers' entire liability and your exclusive remedy 
  81. shall be, at FormFeed's option, either (a) return of the price paid, or 
  82. (b) repair or replacement of the Software that does not meet the Limited 
  83. Warranty and which is returned to FormFeed with a copy of your receipt.  
  84. DO NOT RETURN ANY PRODUCT UNTIL YOU HAVE CALLED THE E-MAILED FORMFEED CUSTOMER 
  85. SERVICE DEPARTMENT AND OBTAINED A RETURN AUTHORIZATION NUMBER.  This 
  86. Limited Warranty is void if Software fails as a result of accident, abuse, 
  87. or misapplication.  Any replacement Software will be warranted for the 
  88. remainder of the original warranty period or thirty (30) days, whichever 
  89. is longer.

  91. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORMFEED AND ITS 
  92. SUPPLIERS DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, 
  93. INCLUDING, BUT NOT LIMITED TO,  ANY IMPLIED WARRANTIES OF MERCHANTABILITY, 
  94. FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR TITLE, WITH REGARD 
  95. TO THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION.  THIS LIMITED WARRANTY 
  96. GIVES YOU SPECIFIC LEGAL RIGHTS.  YOU MAY HAVE OTHERS, WHICH VARY FROM 
  97. STATE TO STATE OR JURISDICTION TO JURISDICTION.

  99. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 
  100. FORMFEED OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER 
  101. (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  102. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER 
  103. PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THIS 
  104. FORMFEED PRODUCT, EVEN IF FORMFEED HAS BEEN ADVISED OF THE POSSIBILITY 
  105. OF SUCH DAMAGES. IN ANY CASE, FORMFEED'S ENTIRE LIABILITY UNDER ANY 
  106. PROVISION OF THIS LICENSE AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY 
  107. PAID BY YOU FOR THE SOFTWARE PRODUCT. 
  108.  
  109. GENERAL PROVISIONS
  110. This License Agreement may only be modified in writing signed by you and 
  111. an authorized officer of FormFeed.  If any provision of this License 
  112. Agreement is found void or unenforceable, the remainder will remain valid 
  113. and enforceable according to its terms.  If any remedy provided is 
  114. determined to have failed for its essential purpose, all limitations of 
  115. liability and exclusions of damages set forth in the Limited Warranty 
  116. shall remain in effect.
  117.  
  118. This License Agreement shall be construed, interpreted and governed by the 
  119. laws of the State of Texas, U.S.A.  This License Agreement gives you 
  120. specific legal rights; you may have others which vary from state to state 
  121. and from country to country.  FormFeed reserves all rights not 
  122. specifically granted in this License Agreement.
