  8.          All German armed forces in HOLLAND, in
  9.         northwest Germany including all islands,
  10.                     and in DENMARK.
  11.

  13. 1.  The German Command agrees to the surrender of all armed
  14.     forces in HOLLAND, in northwest GERMANY including the
  15.     FRISLIAN ISLANDS and HELIGOLAND and all islands, in
  16.     SCHLESWIG-HOLSTEIN, and in DENMARK, to the C.-in-C. 21
  17.     Army Group.

  19.     =This to include all naval ships in these areas=
  20.  
  21.     These forces to lay down their arms and to surrender
  22.     unconditionally.

  25. 2.  All hostilities on land, on sea, or in the air by German
  26.     forces in the above areas to cease at 0800 hrs. British
  27.     Double Summer Time on Saturday 5 May 1945.

  30. 3.  The German command to carry out at once, and without
  31.     argument or comment, all further orders that will be issued
  32.     by the Allied Powers on any subject.
  33.  
  34.  
  35. 4.  Disobedience of orders, or failure to comply with them, will
  36.     be regarded as a breach of these surrender terms and will be
  37.     dealt with by the Allied Powers in accordance with the laws
  38.     and usages of war.
  39.  
  40.  
  41. 5.  This insturment of surrender is independent of, without pre-
  42.     judice to, and will be superseded by any general instrument
  43.     of surrender imposed by or on behalf of the Allied Powers
  44.     and applicable to Germany and the German armed forces as a
  45.     whole.

  48. 6.  This instument of surrender is written in English and in German.
  49.  
  50.     The English version is the authentic text.

  53. 7.  The decision of the Allied Powers will be final if any doubt
  54.     or dispute arise as to the meaning or intrepretation of the
  55.     surrender terms.

  101.                ACT OF MILITARY SURRENDER

  105.           1.    We the undersigned, acting by authority
  106.  
  107.      of the German High Command, hereby surrender
  108.  
  109.      unconditionally to the Supreme Commander, Allied
  110.  
  111.      Expeditionary Forces and simultaneously to the
  112.  
  113.      Soviet High Command all forces on land, sea and in
  114.  
  115.      the air who are at this date under German control.
  116.  
  117.           2.    The German High Command will at once
  118.  
  119.      issue orders to all German military, naval and
  120.  
  121.      air authorties and to all forces under German
  122.  
  123.      control to cease active operations at =2301= hours
  124.  
  125.      Central European time on   = 8 May =     and to
  126.  
  127.      remain in the positions occupied at that time.  No
  128.  
  129.      ship, vessel, or aircraft is to be scuttled, or any
  130.  
  131.      damage done to their hull, machinery or equipment.

  133.           3.     The German High Command will at once
  134.  
  135.      issue to the appropriate commander, and ensure
  136.  
  137.      the carrying out of any further orders issued by
  138.  
  139.      the Supreme Commander, Allied Expeditionary Force
  140.  
  141.      and by the Soviet High Command.
  142.  
  143.           4.     This act of military surrender is without
  144.  
  145.      prejudice to, and will be superseded by any
  146.  
  147.      general instrument of surrender imposed by, or
  148.  
  149.      on behalf of the United Nations and applicable
  150.  
  151.      to GERMANY and the German armed forces as a whole.

  153.          5.     In the event of the German High Command
  154.  
  155.      or any of the forces under their control failing
  156.  
  157.      to act in accordance with this Act of Surrender,
  158.  
  159.      the Supreme  Commander, Allied Expeditionary Force
  160.  
  161.      and the Soviet High Command will take such punitive
  162.  
  163.      or other action as they deem appropriate.

  274.           1.  For the purpose of these orders all formations,

  276.      units, and personnel of the German Navy together with the

  278.      Marine Kusten Polizie shall be refered to as the German

  280.      Naval Forces.

  282.          2.  Members of the Marine Kusten Polizie will

  284.      immediately be placed under the command of the appropriate

  286.      German Naval Commanders who will be responsible for their
