  2.                LIMITED WARRANTY

  6. MEDIA LIMITED WARRANTY: Fred Fish warrants to the original purchaser only,
  7. that the storage media on which this material is recorded shall be free
  8. from defects in material and workmanship only for a period of ninety (90)
  9. days from the date of original acquisition.  The duration of any
  10. statutorily implied warranty not excluded hereunder shall in no event
  11. exceed this ninety (90) day period.  This warranty does not include defects
  12. arising from accident, abuse, or misapplication.  If a defect covered by
  13. this warranty occurs during this 90-day warranty period, and the media is
  14. returned to the dealer from whom it was acquired not later than five (5)
  15. days of the end of such 90-day period, the dealer may at his option replace
  16. the storage media with new media and return the defective media to Fred
  17. Fish for replacement.  If the dealer is unable or unwilling to replace the
  18. defective media under this media warranty, it can be returned directly to
  19. Fred Fish for replacement.  This warranty gives you specific rights, you
  20. may have other rights which vary from state to state.  Some states do not
  21. allow limitations on how long an implied warranty lasts, so the above
  22. limitations may not apply to you.

  24. DISCLAIMER: EXCEPT AS SET FORTH ABOVE, THIS MATERIAL IS PROVIDED "AS IS"
  25. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, STATUTORY OR
  26. OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF
  27. NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  THE
  28. ENTIRE RISK AS TO THE USE, RESULTS, AND PERFORMANCE OF THIS MATERIAL IS
  29. ASSUMED BY YOU AND IF THE PRODUCT SHOULD PROVE TO BE DEFECTIVE, YOU ASSUME
  30. THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR OTHER REMEDIATION.

  32. LIMITATION OF LIABILITY: THE LIABILITY OF FRED FISH IS LIMITED SOLELY TO
  33. THE REPAIR OR REPLACEMENT OF THE APPLICABLE STORAGE MEDIA.  IN NO EVENT
  34. SHALL FRED FISH AND/OR THE INDIVIDUAL AUTHORS BE LIABLE FOR ANY PROPERTY
  35. DAMAGE, PERSONAL INJURY, LOSS OF USE, OR OTHER INDIRECT, INCIDENTAL, OR
  36. CONSEQUENTIAL COSTS, EXPENSES OR DAMAGES, INCLUDING WITHOUT LIMITATION, ANY
  37. DAMAGES FOR LOST PROFITS, BUSINESS INTERRUPTION, OR DATA WHICH MAY BE LOST
  38. OR RENDERED INACCURATE, EVEN IF FRED FISH AND/OR THE INDIVIDUAL AUTHORS
  39. HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  Some states do not
  40. allow limitations of consequential or incidental damages, or exclusions of
  41. implied warranties, so these limitations or exclusions may not apply to
  42. you.
