The Soft- ware and documentation are copyrighted by and proprietary to WizardWorks, Inc. and/or our suppliers. WizardWorks, Inc. and/or our suppli- ers retain title and ownership of the Software and documentation. You may not modify, translate, disassemble or decompile the Software or documentation in whole or in part. WizardWorks, Inc. may terminate your license immediately if you fail to comply with any term or condition of this agreement. You agree that upon any such termination you will destroy all copies of the Software and documentation subject to your control. This agreement does not grant you any rights to patents, copyrights, trade secrets, trade names, trademarks (whether registered or unregistered), or any rights, franchises or license with respect to the Software and documentation. WARRANTY AND LIMITATION OF LIABILITY Nelther WizardWorks, Inc. nor anyone else Involved In the creation, production, delivery, or licensing of the Software or documen- tation make any warranty or representation of any kind, express or Implied with respect to the Software or documentation, or Its quality, rellability, title or performance, or Its merchantablilty or fitness for any particular purpose .. As a result, the Software and documentation Is provided "AS IS", and you are assuming the entire risk as to their quality and performance. You, and not WizardWorks, Inc ., assume the entire cost of any necessary services or repairs. In no event will WizardWorks, Inc. or anyone else Involved In the creation, production, delivery or licensing of the Software or documentation to be liable to you for any direct, Indirect, special, Incidental, or consequential damages of any kind arising out of the use of the Software or documentation or any defect In the Software or documentation, even If WizardWorks, Inc. or anyone else Involved in the creation, production, delivery, or licensing of the Software of documentation has been advised of the possibility of such defects. In particular WizardWorks, Inc. will have no liablilty for any hardware, software or data stored or used with the Software, Including the costs of repairing, replacing or recovering such hardware, software, or data.
