- - NO CD publishing without publishing authorisation (see below).
-
- - NO distribution authorisation without a sample of your catalog.
-
- - MAGAZINES and BOOKS complimentary or bundled disks distribution is
- regulated. See special provisions bellow.
-
- This font/program, created by Michel Bujardet for Match Software, is
- copyrighted property.
-
- This software is Match Software's intellectual property. Any distribution
- (publication) for any fee, even though presented as "distribution cost", must
- be given written permission prior to any distribution. Permission must also be
- given for "free disks", such as used as incentive for sale of magazines,
- books, or any other product. For on-disk distribution, we do require a copy of
- your catalog and price list before giving any authorization.
-
- In general, this authorization is given very easily. However, we will use any
- legal mean at our disposal against unauthorized distribution.
-
- On-Line distribution
-
- Any on-line distribution is granted limited permission immediatly, as long as
- you obide by the following rules :
-
- 1- The archive and it's content must not be modified in any form. If you wish
- to use an archive system different from the one we used, please do not repack
- your own version, but contact us for the appropriate version
-
- 2 - Please use our FILE_ID.DIZ description enclosed in the archive. If you had
- comments or reservations, please add them at the end of our description.
- Nothing is ruder than to find so called "ratings" from sysops with rude
- comments about our software, when the sysop did not even bother to describe
- the fonts. It should be nice enough to provide intellectual property for free,
- without incuring nasty comments on top of it.
-
- 3 - It is impossible for any shareware author to visit every on-line
- distributor. In order to receive our regular updates and new fonts, please
- send us the submission form at the end of this document.
-
- Special comment for ZiffNet : we have observed on several occasion
- unacceptable comments from your software reviewers about our fonts. You may
- conduct your business the way you feel it is appropriate. However, we do not
- grant you the right to distribute our software before you submit the
- description you intend to place on our font. Any failure to submit this
- material falls into the same rules as described for magazines, and we will
- seek the same compensations if you decided to go forward without our consent.
-
- Floppy disk distribution
-
- If you are currently distributing shareware on floppy disks, please send us
- the submission form at the end of this document, with a copy of your catalog,
- with any disk for your collection that ressembles the one you plan to put our
- font on, for our evaluation. In general, you will receive our authorisation to
- distribute this font on return mail.
-
- Although many shareware librarian prefer their own forms and agreement, we
- strictly require you fill up the form at the end of this document, and send it
- to us with any required material, in order to consider granting you any
- publishing authorisation. Any eventual distribution agreement of your own will
- probably be thoroughsly edited or amended before we agree on it, anyways.
-
- Decadent CD-ROM ?
-
- Through several and repeated experiences, we are sorry to have determined that
- CD-ROM shareware distribution is often doing more harm than good to the
- authors. People who acquire fonts on CD-ROM have absolutely no idea of the
- time and efforts it took us to create them, polish them and altogether energy
- spent into creation. Most of the time, CD-ROM publishers do not even care to
- really explain the shareware principle. And when they do, it is in exactly the
- same manner some bars advertise California law about alcoholism : in the
- closet, very very far from the light. There is no chance for a font, would it
- be the most original and all that, to be properly recognized, when totally
- lost in the middle of megabytes of junk.
-
- Therefore THIS FONT CANNOT, UNDER ANY CIRCUMSTANCE, BE PUT ON CD-ROM without
- prior distribution authorisation.
-
- In order to get the right to distribute this font on CD, you must first
- provide us with a CD taken from the same collection the font will be published
- in, and your catalog and price list. This CD will help us understand how the
- font can be best presented to the public through your CD collection. We will
- eventually provide you with a special version, meant for this publication, and
- technically suited for that purpose.
-
- You must be conscious that the agreement we may eventually grant you will
- follow all principles and uses already observed by the book publishing
- community. this implies, among other things, that we require you not to modify
- the on-disk description of our material, as we communicate it to you, as well
- as the files as they are given to you for publication. The published CD
- containing our material must be sent to us for our record as soon as it is
- available.
-
- Although many shareware librarian prefer their own forms and agreement, we
- strictly require you fill up the form at the end of this document, and send it
- to us with any required material, in order to consider granting you any
- publishing authorisation. Any eventual distribution agreement of your own will
- probably be thoroughsly edited or amended before we agree on it, anyways.
-
- Amazing Magazines
-
- More and more magazines use shareware as a mean to boost their sales. Either
- by inserting a complimentary disk in their copies, or by distributing
- shareware, on-disk or otherwise. It is a terrific idea, to help users discover
- shareware. It is also a terrific commercial idea, because inserting a disk
- most of the time boosts issues sales in a 50 to 70% ratio. Which does not mean
- registrations will explode in the same manner. Especially when the enclosed
- software is not even covered in the paper issue. How come a magazine will
- boost millions into it's cash register, and the authors, who after all provide
- the substance of what is quite the equivalent to thousand words long stories,
- get nothing ?
-
- The very same problem seems to arise nowadays with books as with magazines.
- More and more publishers seem to consider electronic software as a freebee,
- when at the same time negociating fortunes of publishing rights in the
- electronic super highways and multimedia arenas. Book writers do get payed for
- the tremendous time and efforts spent into reviewing and selecting shareware,
- team workers probably get payed to follow through and harass authors for
- publishing authorisations, and users see in big letters everywhere how
- generous is the publishing house, in providing software for free.
-
- It is quite outrageous for reputable publishers to act that way. Would they be
- seing some of their material used by others in such an unrespectful way, no
- doubt they would strongly react !
-
- We require the same from book publishers as from magazines : please fill up
- the submission form at the end this document, and send it to us with a sample
- of your magazine, or any book from the same collection as the one you plan to
- bundle our font with. If you eventually get authorised to publish our font,
- you must send us a copy of the book or the magazine with the accompanying disk
- for our record as soon as it is available.
-
- Confidence does not mean blank check.
-
- This document is placed in the distribution archive of this font as a basis
- for any good will business relationship. You cannot miss it or otherwise
- pretend you did not see it in the archive. It does outline very precisely how
- we intend to conduct our relationship with potential distributors of this
- shareware package, wherever in the world and whenever in time. Simply by
- possessing reading this document, and therefore reading it, you are bound by
- it's good will and gentlemen agreement business proposition. Although this
- font is proposed at no cost to individual computer users, it is not at all a
- public domain. You cannot therefore publish it, edit it or otherwise
- distribute it without our prior knowledge and consent.
-
- You may have got in the past authorisation to publish or distribute another
- one of our shareware font package. You must be aware each font does constitue
- a different product and intellectual property item, and that any agreement
- over any other font does not apply to the present one. Whatever prior
- authorisation you got, you must re-apply for authorisation to distribute the
- present font/program.
-
- We believe simply asking to know where and how our intellectual property is
- sensible and normal. It follows rules constantly observed by honest publishing
- houses worldwide, from United Kingdom to Alaska or Australia in the same
- manner. We hope as publishers yourselves, and probably owning intellectual
- property of your own, you will respect our point of view and the terms of this
- agreement.
-
- However, should you decide not to comply with these simple rules and publish,
- use or distribute any of our fonts or programs without our prior consent, you
- must be warned and agree that we will seek $10,000 U.S. or local monetary
- equivalent for each font or program fraudulently published, distributed or
- used, in any competent courts of law, as a standard penalty for breaking the
- present agreement. This applies to any form of fraud touching our intellectual
- property, from any individual or organisation, would it be non-profit.
-
- Please do not get offended by all these precautions. We only want to insure
- our distributors do their job correctly, properly update the fonts and provide
- the support customers deserve, while they profit from a honest intermediary
- role, which is perfectly fair. And make sure we do profit too, in the process.
- Properly registered shareware distributors, BBS and others will receive
- regular updates and new archives of our current offers, along with a proper
- authorization of distribution.
-
- We thank honest shareware distributors for their job : they are an
- indispensable link between authors and the public. Let us simply make sure all
- benefit from the common good.
