  3. License Agreement

  5. Please read the following terms and conditions carefully before using
  6. the photos or software within this package. The use of the software or
  7. photos indicates your acceptance of these terms and conditions.

  11. Capstone Design grants the user a license to use the image data
  12. copyright in which is owned by Capstone Design, from the original CD
  13. disc only. All of the images remain the property of Capstone Design but
  14. can be used royalty free by the licensee for personal use or for page
  15. layout or proofing purposes.

  17. The CD disc may be loaded onto a bulletin board system (BBS) and the
  18. images may be downloaded for personal use as long as this license
  19. agreement is visible in each directory where the images are located.
  20.  
  21. For commercial use the user must purchase the Capstone Collection
  22. Photo-CD disc or Duplicate Transparency which have a Royalty Free
  23. license including all uses of the image data except that it may not be
  24. sold in its raw form ie as a postcard or poster and may not be included
  25. in any other Photo or Clipart collection.

  29. Copyright in the original photographic images is retained by Capstone
  30. Design. The licensee may use the GIF images for personal use or page
  31. layout or proofing purposes without payment of royalties but
  32. may not sell copies of the image disk or any image from the disk in any
  33. format for royalty free usage by others. Copyright in the collection of
  34. photographs published as The Capstone Collection and in their
  35. arrangement on the disk and in any other software on the disk (where not
  36. otherwise stated) belongs to UNICA Ltd (C) 1994.

  38. Warranty

  40. UNICA Ltd guarantees this product against defects in manufacture for a
  41. period of 90 days from the date of purchase. If the complete package is
  42. returned together with proof of purchase then it will be replaced free
  43. of charge.

  45. This CD-ROM disk, the photographic images and all software contained on
  46. it are provided'as is'. Neither UNICA Ltd nor Capstone Design make any
  47. other warranties of any kind either express or implied as to the
  48. merchantability, suitability of this product for any purpose, type or
  49. quality of any image or compatibility with any computer or other kind of
  50. equipment. Neither UNICA Ltd nor Capstone Design nor any of their
  51. directors, officers, employees, partners, agents or any other person
  52. shall be liable for any damages, whether direct, indirect, consequential
  53. or incidental, arising out of the use of, or inability to use this
  54. product.
