Day 013 - 19 Jul 94 - Page 07
1 by statements reported in the press, neither of your
offices threatened to initiate legal action against
2 McDonald's". I do not know whether you have Steve
Gardner's statement there?
3
MR. JUSTICE BELL: Do not ask him to look at the statement
4 unless he must.
5 MS. STEEL: No. I am after looking at the letter that is
exhibited to it.
6
MR. RAMPTON: If a witness is a Civil Evidence Act witness,
7 I am not sure it is procedurally proper to put his
statement in front of him.
8
MR. JUSTICE BELL: I was going to suggest in any event it would
9 be shorter if you wanted to put something in the
statement, but it is actually a letter exhibited to it, is
10 it?
11 MS. STEEL: Yes.
12 MR. JUSTICE BELL: Can you give us the reference for that?
13 MS. STEEL: It is exhibit 1 to Mr. Gardner's statement.
14 MR. JUSTICE BELL: It is 6th May 1986 letter, is that it?
15 MS. STEEL: Yes, that is right. Is there a spare copy
somewhere? (Handed).
16
Q. If you look at the first paragraph?
17 A. Look at the first paragraph of May 6th 1986 letter?
18 Q. Yes.
A. OK, to Mr. Rensi -- let me take a second to read that
19 then. OK. I have read it.
20 Q. Would you agree, although I accept it does not say: "We
are going to take action", there is a hint there that they
21 are considering legal action?
A. Well, I would just say that on the plain words as
22 I read this now it says they are undecided as to whether
any formal actions are warranted.
23
Q. Yes, but it does also say prior to making that
24 determination, so they are hinting that they are looking
into something?
25 A. They are hinting. I suspect one could infer they are
hinting that they are looking into something, yes.
26
Q. Then in the letter of June 3rd, which is at tab 9B in that
27 file in the last paragraph?
A. Sorry, tab what?
28
Q. Tab 9B, pink VI?
29 A. Yes, 9B, yes.
30 Q. The last paragraph of that letter which is on 186F?
A. Yes.
