Q. Do you still think it is fair to say that, as you said
2 yesterday, I think your discussions on the ingredients
brochures sort of came up out of the blue when Mr. Mandell
3 rang you up for a chat to find out how you were getting
on, how McDonald's were doing?
4 A. There were conversations which took place. I do not
recall, as you are suggesting, that it had anything to do
5 with or was a consequence of this investigation. My best
recollection is that the discussions which led to it were
6 of an informal nature which resulted in informal, very
informal, voluntary agreement with them.

Q. Right. What was that voluntary agreement then?
8 A. I beg your pardon?
9 Q. What was that voluntary agreement?
A. That we were, the fact that we would produce -- I do
10 not recall if it took written form, it may have -- but the
fact is that we would do a joint press release and stress
11 something to the effect that we had the same goals, that
is, to bring greater nutritional information to the
12 general public. Is it possible that there was a letter
from Mr. Mandell which initiated that phone call? I guess
13 that is possible; I do not remember that.
14 Q. Right.
A. I do have one further thing I would add to that.
15 I would say that is it possible that we had discussions
about what we might be doing in the future with
16 Mr. Mandell at this time? I guess that is possible,
although it is difficult to recollect exactly the time
17 period here.
