Day 013 - 19 Jul 94 - Page 12
1 out?
A. That is correct.
2
Q. Yes.
3
MR. RAMPTON: I do not quite understand whether it is the
4 defendants' case that this or an earlier version of this
leaflet was or was not distributed in New York sometime,
5 first in April 1986. If it is their case it was not so,
then they must put it to Mr. Horwitz so he can deal with
6 it.
7 MR. JUSTICE BELL: Yes. What are you getting at?
8 MS. STEEL: I am just trying to determine when exactly ----
9 MR. JUSTICE BELL: Are you putting a positive case or are you
just enquiring?
10
MS. STEEL: I think I am just enquiring at the moment.
11
MR. JUSTICE BELL: I have to say -- it is a matter for you;
12 I do not want to cut you short -- you seem to have got
about as far as you can on dates with this witness.
13 Whether more will come out in the course of the trial, I
do not know.
14
MS. STEEL: Right.
15
MR. JUSTICE BELL: It is fair enough to approach it from more
16 than one direction, but can you help any more on when it
was first published exactly?
17 A. When this particular ----?
18 Q. Yes.
A. I cannot.
19
MR. MORRIS: It does say on that page 96, "The ingredient
20 listings in this booklet are effective as of August 1986";
I think August 15th was the date originally set by
21 McDonald's to go national.
22 MR. JUSTICE BELL: It promises an updated version periodically.
23 MS. STEEL (To the witness): Can we just go back now to the
letter of July 21st on page, I think it is 190 we are on.
24 A. Tab number, if you will, please?
25 Q. Tab 11.
A. I am there.
26
Q. Right. In the middle of paragraph 6 there is a sentence
27 which reads: "We had several telephone conversations with
your representatives late in June" ----
28 A. Excuse me, you said tab 11?
29 Q. Yes.
30 MR. JUSTICE BELL: Page 190.
A. Thank you. Item 6, OK, I am there.
