Day 013 - 19 Jul 94 - Page 15

1 MR. JUSTICE BELL: We will see how we go. You may have a good
point, but when I read "We are not able to spell out the
2 company's plans", in ordinary English to me at the moment
that can mean "I physically cannot do it", or "I do not
3 propose to do it"; just as you learnt something
confidential and you say: "I am not able to tell you
     4        about that".  Of course, you physically can tell someone;
what you mean is that, for various reasons, you do not
5 propose to. You are suggesting it means they were saying
they physically could not do it?
     6
MS. STEEL: It says: "We reported we would not be able to
7 spell out the company's plans".

     8 MR. JUSTICE BELL: Yes.

9 MS. STEEL: I put the question about why not put that you are
not willing to spell out the company's plans?
    10
MR. JUSTICE BELL: Yes. There we are.
    11
MS. STEEL: Do you think we could have the five minute break
    12 now?

13 MR. JUSTICE BELL: Yes. We will have our break now.

    14 (Short Adjournment)
         (11.35 a.m.)
15 MR. MORRIS: Just very briefly to wind up this, the brochures
issue. When you had the meeting with the Attorneys
16 General which you attended regarding the national
distribution of brochures, do you feel they took no legal
17 action because in the end, as you were making national
distribution, as you say, that really they were doing what
18 you wanted them to do anyway? You had the same goals,
              basically, national distribution?
19 A. The meeting which you characterise concerning the
brochures, I recall, was called to discuss -- that was the
20 series of meetings they had with a number of different
quick service restaurant organisations in order to discuss
21 their outlook on labelling and for us to express ours
              also.
    22
         Q. Would you say you had the same goals then basically as
    23 them?
              A. In terms of informing greater information to the
24 consumer, if that was their goal, the answer is yes.

25 Q. Was that the impression you got?
              A. Yes, the impression -- the impression, I recall, was
26 that they wanted greater information for the consumer.
              That also was the ---
    27
         Q. Your goal?
28 A. -- the goal of the Federal Governmental authorities at
              that time also.
    29
         Q. The meeting you had with the New York Attorney General you
30 felt you had the same goals with them as well, when you
              had the meeting earlier?
