premiums to children directly, as a pitchman, or directly

McDonald House."

MR. JUSTICE BELL: "He does not sell products or premiums to
children" comes after "he is not a pitchman".

MS. STEEL: That is specifically laying down the line, is it
not, that he should deceive children?
A. I do not think so, at all.

Q. He should deceive children into thinking that he is not a
salesman, when the reality is that he is?
A. I think children can see exactly what he is on the
commercials. There is no deception at all.

Q. On page 59, there is Grimace, is that right, and he was
originally conceived to represent McDonald's shakes?
A. That is correct; and he has changed over the years.
I think, if you read the one that was specific to the
commercials that you saw, you would get a better idea of
how he is being used in the commercials. I think that is
on page 132.

Q. The one for 1987 also mentions about him being conceived to
represent shakes, as well?
A. That is correct.

Q. Going on to page 61 and Birdie:

"Birdie, the Early Bird symbolizes breakfast at
McDonald's: As an Early Bird, Birdie greets the morning
with particular delight. Especially because morning means
breakfast at McDonald's."

Is that the purpose of using Birdie, to suggest that
children should go to McDonald's for their breakfast?
A. Initially, Birdie was introduced when we introduced
breakfast. I think you can see the contemporary use of
Birdie on page 134.

Q. Going on to the second paragraph, she "encourages her
friends to start the day with a good breakfast". Then, a
sentence later: "And she lets her friends know that
McDonald's serves a good one."
A. Yes. I think that was one of the original thoughts
when we had just introduced breakfast. But that is not her
role at the current moment.

Q. Was the suggestion there that it was a good idea to go to
McDonald's for your breakfast every day?
A. Again, can you point me to that one more time?

Q. On page 61 she is encouraging her friends "to start the day
with a good breakfast..... and she lets her friends know
that McDonald's serve a good one"?
A. Yes.

Q. In fact, she says: "'You can't get off the ground without
breakfast'"?
