Day 051 - 14 Nov 94 - Page 03

MR. JUSTICE BELL: -- November?

MR. RAMPTON: Yes.

MR. JUSTICE BELL: Having had our procedural applications on
Monday 21st, Tuesday 22nd, if necessary, and kept Wednesday
23rd blank.

MR. RAMPTON: My Lord, yes. It would mean, if Mr. Mallinson had
to come back on Wednesday 30th -- I cannot move Professor
Ashworth again -- Mr. Oakley would not then start until
Thursday 1st which would mean a sideways shunt probably of
the Defendants' recycling and waste witnesses to Tuesday
6th or so, but since Thursday and Friday -----

MR. JUSTICE BELL: If that did happen, who would be on Monday,
28th?

MR. RAMPTON: Monday, that would still be Mr. Mallinson.

MR. JUSTICE BELL: And then Tuesday?

MR. RAMPTON: Tuesday he cannot do and, anyway, I have Mr. Stump
and Professor Ashworth down for Tuesday.

MR. JUSTICE BELL: Then you are suggesting that Mr. Mallinson
come back on Thursday?

MR. RAMPTON: Finishes off on Wednesday; both Mr. Stump and
Professor Ashworth will be relatively short witnesses,
I hope; Mr. Mallinson to finish on the Wednesday, I would
hope; Mr. Oakley to start either on Wednesday afternoon or
Thursday morning, remembering, I think it is right, that
the Defendants' only substantial witness on recycling and
waste at the moment is Mr. Hopkins.

MR. JUSTICE BELL: Unless and until there is another.

MR. RAMPTON: Yes, unless they reinstate a substitute for
Ms. Carroll. But, as your Lordship will see, Thursday and
Friday of that week are blank anyway.

My Lord, might I in the light of that hand in a piece of
work which Mrs. Brinley-Codd has done over the weekend? I
do it for this, reason that your Lordship indicated that at
some stage -- this seemed to us as good a stage as any to
have a preliminary look at it -- your Lordship would like
to have a think about the progress of the case overall. We
have one for the Defendants.

MR. JUSTICE BELL: Shall we deal with that first and then the
matter you have just raised?

MR. RAMPTON: It is a matter for your Lordship.

MR. JUSTICE BELL: Yes. If Mr. Mallinson were to come on Monday
28th and Wednesday 30th, would Ms. Dibb, looking at it as
best one can at the moment, be likely to be able to give
evidence on Thursday 24th and Friday 25th?
