     4   MR. JUSTICE BELL:  Is what you are saying this, because I have
     5        found it pretty confusing heretofore, in fact, you will,
     6        leave aside whether you let unsatisfactory meat which is
     7        over 10 million through -- I do not think we need, I hope
     8        we do not need to go through that again -- but in your
     9        statement you are saying, in fact, it will not be
    10        unsatisfactory unless the TVC is more than 10 million per
    11        gramme?
    12        A.  Yes, sir.

    14   Q.   In fact, what you are telling your suppliers in the
    15        microbiological guidelines is that you will sample test and
    16        grade all consignments for beef which come in from there,
    17        and there should not be a TVC greater than five million?
    18        A.  On the meat, yes.  That, sir, is taken from the
    19        McDonald's spec. on burgers.  That is the meat spec..

    21   Q.   Is what you are saying if you can impose a higher standard
    22        on your suppliers ---
    23        A.  Yes, sir.

    25   Q.   -- so much the better?
    26        A.  Well, you have got to, if you are going to make sure
    27        you are going to end up well within the McDonald's spec.
    28        you have got to have a tighter spec. on your meat

    31   MR. MORRIS:  This document, pages 38 and 39, is not something
    32        sent to the suppliers, is it?  It is something for internal
    33        use at McKey's?

    35   MR. JUSTICE BELL:  Is that right?
    36        A.  I am not sure whether this goes to the suppliers.
    37        I would suspect for them to achieve the targets and for
    38        them to know the targets that they have got to achieve, it
    39        would go to the suppliers.

    41   MR. MORRIS:  So as far as you are concerned anyway, when you
    42        test for microbiological standards, it is the higher
    43        standard that you are looking for, is it, the five million
    44        standard?
    45        A.  This one, yes.  The meat one.

    47   Q.   So anything over five million is unsatisfactory?
    48        A.  Yes.

    50   MR. JUSTICE BELL:  I suggest you leave it there, you know.  We 
    51        have had the evidence and I will just have to wait to see 
    52        what evidence there is in due course as to whether five 
    53        million is in health terms unsatisfactory or 10 is or some
    54        greater figure.

    56   MR. MORRIS:  Just one question:  In paragraph 20 in your
    57        statement, you said that you started to test on a random
    58        basis for E.coli in July 1990?
