     2   MR. MORRIS:  I was not going to put all those again.

     4   MR. JUSTICE BELL:  No.  Do not put them unless you have heard
     5        something in the course of the case which you think might
     6        be a ground for me to reach a different conclusion.  Before
     7        then asking you to give any more description on discovery
     8        of documents, when could you get that list out?  Could
     9        everyone have it by mid-day on Friday, for instance?

    11   MR. MORRIS:  I could probably do it by then.

    13   MR. JUSTICE BELL:  I think you should.  I think you should be
    14        able to do a complete list by then, but if you run into
    15        trouble as of the list as you have made by then.  Would
    16        Mrs. Brinley-Codd be able to get a copy on to me,
    17        Mr. Rampton?

    19   MR. RAMPTON:  My Lord, yes.

    21   MR. JUSTICE BELL:  If it could be delivered by hand, I would be
    22        grateful, because if it goes into the post room there can
    23        be up to two days delay.

    25   MR. RAMPTON:  I am not trying to put pressure on the Defendants
    26        at all because, obviously, it is desirable they get as much
    27        into the list as they possibly can.  Equally, on the other
    28        hand, the more time we have to consider the list the
    29        likelier it is that there will be a measure of agreement on
    30        Monday.

    32   MR. JUSTICE BELL:  Do your very best for 12 noon on Friday.

    34   MR. MORRIS:  It will not be a comprehensive list.  It will be
    35        what I can remember.  Obviously, item 2 I will not argue
    36        now.  That is about we need some kind of system.
    37        Mrs. Brinley-Codd had helpfully started doing some kind of
    38        new listing.

    40   MR. JUSTICE BELL:  We can come back to that on Monday, unless
    41        you want, as we have time, to deal with it now.  Quite
    42        frankly, I think there is a lot to be said for cantering
    43        through that list and you getting away and getting on with
    44        making out your list of documents.

    46   MR. MORRIS:  Yes.  I do not particularly want to argue all these
    47        points now.  The third one is our food poisoning expert.

    51   MR. MORRIS:  The fourth one, I did not last night identify all 
    52        the documents but there may be some Civil Evidence Act 
    53        documents that we would bring up.

    55   MR. JUSTICE BELL:  What is the topic for No. 4?  Is it you are
    56        concerned about whether you put notices on documents, or
    57        you want to tell me about documents you would like to be
    58        treated as subject to a Civil Evidence Act Notice?

    60   MR. MORRIS:  No.  I just think it is an ongoing thing, really.
