     2        A.  Yes.  If we wanted them to notify the fact that they
     3        rejected at above the temperature, then we would have put a
     4        box in there for them to indicate that.  If you look at the
     5        sheet, there is a summary of a number bins, you know, and
     6        it just gives you an idea of the standards they operate to.

     8   MR. JUSTICE BELL:  What is being put to you is the fact that
     9        someone has not written anything on page 1 is an indication
    10        that the 5.2 one has not, in fact, been rejected although
    11        it is 5.2.  That is the point of the cross-examination.
    12        A.  No.

    14   Q.   What do you say about that?
    15        A.  Well, I say that bin would have been rejected.  I do
    16        not know if it is only one bin because, if you look back on
    17        the 5.2 to the supplier, there are actually 6 bins
    18        received.  The maximum temperature was 5.2.  There may well
    19        have been one at 5.1.  I would have expected that to have
    20        been rejected as well, but you cannot record everything on
    21        a summary sheet.  If I went back to the facility and said:
    22         "Look, I want to check your more detailed records", then
    23        they certainly have a sheet there which indicates that the
    24        bin would have been rejected.

    26   MS. STEEL:  But you do not know that, do you?
    27        A.  Well, I do know that, yes.

    29   Q.   They do not tell you usually specifically when they have
    30        rejected a bin; you just assume that they are working to
    31        those specifications?
    32        A.  There is a whole of lot of information they do not tell
    33        us.  We just ask for them to send into us some information.

    35   Q.   But you do not ask for anything about how many consignments
    36        of chicken are rejected?
    37        A.  No, we do not ask for that information.

    39   MR. MORRIS:  This is the form that McDonald's actually gets,
    40        yes?  That is the complete summary for the week on the
    41        material shipped to you, or whatever.  So, in other words,
    42        you would not know, would you, unless you were told that a
    43        bin had been rejected, whether you are paying for things
    44        you are not actually receiving?  It makes sense, does it
    45        not, that you would have to be informed on the form?
    46        A.  Sorry, can you say that again?

    48   Q.   You would want to know how many bins have been rejected,
    49        otherwise you might feel -- it says:  "Bins received" and
    50        if you had received that to be one less than that -----

    52   MR. JUSTICE BELL:  No.  Where are you looking?  That is bins of 
    53        raw meat received.

    58        paying for stuff, processed food, which they have never
    59        received.
