Day 103 - 14 Mar 95 - Page 21
accepted that they were genuine findings of bones?
A. Yes.

Q. You accept that.

MR. JUSTICE BELL: For every one complaint you get you will get
half a dozen ordinary British people who just say to the
person: "Oh, look, there is a bone" and put it on the side
of their plate and forget all about it?
A. That is correct.

Q. So even if you had X numbers of complaints about the bones,
you could multiply it by five, 10 or 100 for the ones who
did not bother to complain?
A. Of course.

MR. MORRIS: And they all get through your X-ray machine, do
they not?
A. Well, the X-ray machine is something that has been
installed about a year ago, but we have improved its
performance and I believe its performance is improving.
So, it will not detect everything but it does detect a
substantial number which avoid it getting to the customer.

Q. Maybe we will move off that.

MR. JUSTICE BELL: Yes, you have underlined your point.

MR. MORRIS: Yes. If you go on the next page, you have page 2?
A. Yes.

Q. On this page there is something, if you look under "Jamain"
at the end, the maximum temperature is 5.10 degrees.
Underneath it says "bin rejected"; do you see that?
A. Yes.

Q. Why is that written on there like that?
A. Well, if the temperature -----

MR. JUSTICE BELL: Did we not go through all that?

MR. MORRIS: No, we did not. That was Mr. Kenny. Why is it
written "bin rejected"?
A. Because the temperature specification is four degrees
maximum.

Q. So if anything is over four degrees somebody would make a
star, would they, and put "bin rejected"?
A. Yes.

Q. Otherwise it would not have been rejected, you would not
know, would you?
A. Well, the temperature is taken when the bin arrives at
the factory. If it is above four degrees which is the
specification, it is rejected and that is -----

Q. But how do you know it is rejected?
A. Well, because that is the procedure; that is how it has
been reported.
