Day 127 - 23 May 95 - Page 08
about the video is that tomorrow morning is not
particularly the best time, if she can get hold of her
video and look at the health and safety tapes disclosed by
the Plaintiffs.

So, I do not think that is a matter that should delay
things more than half a day or something or a day.

As far as my cross-examination is concerned, I was going to
deal with the Mark Hopkins incident anyway. We did get
some extremely important material late on Friday and
yesterday which the Plaintiffs have had in their possession
for at least a couple of years. I think, in all the
circumstances, one way of going ahead would be that if
I could defer my cross-examination of Mrs. Barnes until
after the scheduled half term, perhaps Ms. Steel can deal
with her matters this week and at least we will have,
hopefully, three quarters dealt with Mrs. Barnes' evidence
by the end of this week. It will just be myself to clear
up the rest of the matter that I want to deal with but, in
particular, the Mark Hopkins material which we shall want
to send and get comments on from our witnesses.

If it helps, the Mark Hopkins material that has been sent,
one of them is an internal report by the Company -----

MR. JUSTICE BELL: I have read all the additional documents,
yes.

MR. MORRIS: Can I just make one comment -- it is not a
fundamental comment -- the transcripts are no substitute
for seeing someone give their evidence, but there you are.

MR. JUSTICE BELL: What stage has your son reached with using
his frame at the moment? Can he actually move around on
it?

MR. MORRIS: Yes, he can move around but only for a short period
because his leg gets painful and tired. He would not be
able -----

MR. JUSTICE BELL: Is he actually in a plaster or a splinter of
some kind?

MR. MORRIS: Yes, it is a top to toe.

MR. JUSTICE BELL: But it is plaster, is it?

MR. MORRIS: Plaster.

MR. JUSTICE BELL: Yes. Is there anything else you want to say
or anything else Ms. Steel wants to say?

MS. STEEL: Just on, I mean, if that is the course proposed,
I have to say, really, I do not have any grounding on
health and safety materials, so I am doubtful I am going to
have a large number of questions anyway. I am pretty sure
tat I am unlikely to have more than a day in which case
I would be grateful, I would prefer to do it on Thursday if
that is the course that is going to be taken, so at least
