Day 148 - 05 Jul 95 - Page 02

                                     Wednesday, 5th July 1995.

MR. MORRIS: Before we start, I think there is something in
Monday's transcript which you might want to keep in
chambers which now has been declared, effectively, in open
court. It happened on Monday but it was a comment by
Mr. Rampton regarding a matter which was in chambers last
week which I am sure you would want to keep in chambers.

MR. JUSTICE BELL: Can you give me the reference in the
transcript and I will look at it?

MR. MORRIS: Yes, it is day 146. It was Monday, page 23, line
       33.

MR. JUSTICE BELL: Give me the page on Monday, Mr. Morris.

MR. MORRIS: It was 23, line 33. I was wondering whether the
page should be reprinted without that comment.

MR. JUSTICE BELL: I do not think so. It is the sort of comment
which was made quite openly, is it not, in relation to
witnesses on one side or the other?

MR. MORRIS: I did not want to read out what it said. Have
       I got the right line?

MR. JUSTICE BELL: I think you may not. Are you thinking of
       what I said?

MR. MORRIS: No, it is what Mr. Rampton said about Mr. Secret.

MR. JUSTICE BELL: I think you had better check because at the
moment I cannot see anything objectionable about that at
all. It is a comment about Mr. Secret.

MR. MORRIS: We are not objecting to it. It is just that the
first word in line 33 ----

MR. JUSTICE BELL: It is very good of you to mention that, but
I have no concern about it and there is no reason why you
       should have, is there?

MR. MORRIS: I just thought it was something that you
       yourself -----

MR. JUSTICE BELL: No. Thank you very much for mentioning it,
       but I am not concerned.

MR. RAMPTON: I have a broad sense of humour sometimes.

MR. JUSTICE BELL: Thank you for mentioning it in case I was
       embarrassed in any way.

MR. MORRIS: It was not a criticism of Mr. Rampton because it
was in chambers when that was said, but it is now in open
       court.

Today there are some comments we want to make regarding the
Plaintiffs' applications and points they made. There is
