Day 148 - 05 Jul 95 - Page 25

MR. JUSTICE BELL: Yes, it was a ruling on 27th February.

  MR. MORRIS: Right.

MR. JUSTICE BELL: What are you asking for in relation to that?

MR. MORRIS: The bottom paragraph on the first page, the whole
of the next page and the top of page 3. You have
recognised at the top of page 3 that what they have,
effectively, been asked to do was to answer an
interrogatory by making a list. It should not be an
onerous task of trawling through hundreds of general files.

MR. JUSTICE BELL: Let me read again what I said. What are you
saying, that you have not heard any more about that?

MR. MORRIS: I think the Plaintiffs have indicated that they
have responded, but I am not sure if they have. So I would
like maybe Mr. Rampton to identify if they have responded
and whether we think that is satisfactory. We have heard
in evidence that there was quite a dramatic reduction in
the number of suppliers sometime in the mid 80s in America,
and that what we are really trying to identify is the
suppliers that existed in the early 80s, early to mid 80s.

MR. JUSTICE BELL: Leave that then. Wait and see what, if
anything, Mr. Rampton says in due course when he replies to
       your applications.

MR. MORRIS: I think that completes our application for
discovery. We did concentrate on -- sorry, there are a few
       others.

MS. STEEL: There are documents referred to by Mr. Stein. We
were asking him about the turnover figures on day 144 which
is 27th, it is 28th June -- I think the date is wrong on
       the transcript -- on page 62 -----

  MR. JUSTICE BELL: Page?

  MS. STEEL: Page 62.

  MR. JUSTICE BELL: 28th -----

MS. STEEL: I think the date on the front is 27th; I think it is
       wrong.

MR. JUSTICE BELL: That is right.

MS. STEEL: At the top of the page I asked him: "So the
Company has figures on how many people left in given months
and how many people in total were employed by the Company
at the end of the year?" He said: "Yes, the computer can
do that; not by individual but by numbers, they can give me
       total numbers."

That is in relation to the turnover figures that we were
given. I think it would be extremely helpful (and I think
the Plaintiffs ought to do it) to provide those actual
