Day 156 - 17 Jul 95 - Page 03

Q. -- as long as their clock card was not filled in?
A. What do you mean their "clock card"?

Q. What I am saying is people could have worked passed their
legal time, if that had not be been recorded so that you
could have seen it?
A. But ninety-nine times out of 100 people, it was in
their own interests to clock in and out.

Q. Just so that they could clock out at 9.45 or 10 o'clock and
carry on working and some other means could be found for
paying that person?
A. That is obviously a way around it.

Q. All I am saying is that you were only there for 35 hours a
week, so you would not personally know at the actual time
everybody finished ---
A. No.

Q. -- in reality?
A. No, but also you can look at it the other way, that the
management team that I built up and created, part of their
responsibilities was to enforce my policies as well.

Q. The ethnic mix that Mr. Magee had quoted in his statement
-- do you want to go to his statement? I do not know
which file it is in.

MR. JUSTICE BELL: It is pale blue volume II in section B which
is towards the back. It is divider 3 at the bottom of page
12.

MR. MORRIS: At the bottom of page 12 Mr. Magee says about
regarding ethnic mix in the store, about 15 per cent
Chinese, 15 per cent Mauritian, 30 per cent Greek origin,
15 per cent white and 25 per cent blacks, as he puts it.
I know you have already said that you employed people,
whoever was willing -- the words used -- and able to work
for you, but would that roughly represent kind of an
accurate picture?
A. I could not really tell you.

Q. Is there anything that sticks out in your mind as being
inaccurate about it?
A. No, it does not appear to be.

Q. You can put that to one side for the moment. In your own
statement -- do you have that? Yellow X.

MR. JUSTICE BELL: If you go to the divider 18 in that?

MR. MORRIS: If you look at page 10 of your supplementary
statement, at the bottom of page 10, you say that you deny
many employees worked in excess of 39 hours; crew were not
scheduled to work more than 39 hours a week. When you say:
"crew were not scheduled to work more than 39 hours a
week", was that a rule, you would not schedule anyone to
work more than 39 hours a week?
A. Well, it was a general policy that I had used for so
