Day 156 - 17 Jul 95 - Page 18

  MR. JUSTICE BELL: Yes.

MS. STEEL: There was also a couple of documents which I asked
Mrs. Brinley-Codd if we could have copies of last week,
which I have not heard anything back yet.

MR. JUSTICE BELL: What are they? We will not enter into a
discussion on it now, but if you could just say what they
       are.

MS. STEEL: A copy of the raised chart concerning the percentage
of crew getting five pence, 10 pence and 15 pence
increases, and then UK Management and Crew
Scheduling Programme which is mentioned in the NDP3 which
is tab 15 -- I cannot remember what volume it is -- page
       607. I think it is pink, it might be, XII or XIII. I am
not sure, but it is tab 15.

MR. JUSTICE BELL: Yes. Was there anything else, Ms. Steel or
Mr. Morris, which you had in mind to mention?

MS. STEEL: It is vaguely possible something about a
counterclaim but, to be honest, I have not really had time
to sort it out, so I do not think that I will be ready for
       that.

MR. JUSTICE BELL: Right. It is up to you to bring that forward
at an appropriate time if you have something there.
       Anything else?

MR. MORRIS: I do not think so; that is quite enough.

MR. JUSTICE BELL: No. Was there anything else you wanted to
       deal with, Mr. Rampton?

MR. RAMPTON: No, my Lord. I am looking, if I can, to try to
work out what I am able to do by way of evidence for the
       rest of the week.

MR. JUSTICE BELL: Yes. Should I ask how long those arguments
       are likely to take?

MR. RAMPTON: Your Honour, that is the thing; one does not
really know. If, for example, the transcript argument ran
its full length, according to that list of authorities,
there would not be time for anything else at all tomorrow
and it might not even finish then.

MR. JUSTICE BELL: No, I do not think you should contemplate
anything further tomorrow. It is a question of whether we
are likely to go on to anything further on Thursday.

  MR. RAMPTON: Quite.

MR. JUSTICE BELL: Unless you have a very clear view in your
mind of how long it is likely to take and, quite frankly,
it is difficult on interlocutory things, I think you ought
to have someone or some people peopled warned for Thursday,
preferably people for whom it will not be a particular
