Day 162 - 25 Jul 95 - Page 04

       A. They do not.

  Q. So you do not have a record of the exact numbers of hours
that salaried people would have worked?
       A. No, I do not keep records.

MR. JUSTICE BELL: Just so I understand it, he would be entitled
to go at the end of his eight hour shift?
       A. Yes, sir.

  Q. Equally, if he wanted to stay, if he was so conscientious
or, on the other hand, so obsessive about his work, he
could stay on as long as he wanted to, to do it to his own
       satisfaction?
       A. That is true, sir.

MR. MORRIS: Or if it was necessary for him to stay on because
he did not have enough staff or the work needed to be done,
to count up the waste at night, and he was the one that was
       available, that kind of thing?
       A. The Shift Manager is taking over from him exactly in
time, so there is no reason for him to stay to do the
actual scheduled day's job. You see, every Shift Manager
works eight hours on the floor. After that, they are
entitled to go if they do wish. If they want to stay
behind and do some paperwork, it is up to them, but it is
not essential for them to stay.

  Q. But the paperwork itself is essential and somebody has to
       do it?
       A. Well, it does not have to be done on that day,

  Q. But it has to be done some time?
       A. Allocated times are always there one day a week for
       every Shift Manager.

  Q. What I am saying is that Michael Metcalfe was not inventing
a load of paperwork just for the fun of it?
       A. No, he was not.

  Q. He was doing necessary work?
       A. Yes. He did wish to stay, and he did.

  Q. Right. So, if he had not done that necessary work, if he,
       well -----

MR. JUSTICE BELL: I do not think Miss Anteneh is accepting that
he needed to stay more than eight hours to do the necessary
       work, so -----

MR. MORRIS: No, but somebody had to do the necessary work
       and -----

MR. JUSTICE BELL: Yes. But I do not think she is accepting
that somebody could not do it in their normal scheduled
shift, if the work was spread. So if you are suggesting
that it would need someone or some people to work more than
their scheduled shifts to complete the paperwork, put it to
       her directly.
