Day 162 - 25 Jul 95 - Page 15

MR. JUSTICE BELL: I am really not going to attach anything like
the weight to what someone has said, when they cannot be
tested in cross-examination -- it is hearsay, anyway, and
strictly inadmissible -- when I have had a number of
witnesses (including witnesses called by you) swearing to
tell the truth and then giving quite detailed evidence.

MR. MORRIS: We will leave it there for the moment.

  MR. JUSTICE BELL: Yes.

  MR. MORRIS: No further questions.

  MR. JUSTICE BELL: Thank you.

MR. RAMPTON: I have no re-examination.

MR. JUSTICE BELL: Thank you, Miss Anteneh.

                        (The witness withdrew)

MR. JUSTICE BELL: What I propose to do now is to give my ruling
on the applications to amend, and then we will see if there
is anything further we can usefully do. I have had it word
processed, and I will ask Mr. Riley if he would be kind
enough to hand out copies. I do, in fact, propose to read
out my ruling in this instance. I think it is better to do
so, although it will take a little time to do so. (Handed)

                 (See separate transcript for ruling)

MR. JUSTICE BELL: Now, are there any other matters which we
should or can usefully deal with today?

MR. RAMPTON: No, my Lord, I would not have said so. It is
really a question of how your Lordship would like to start
next term. The Defendants have amendments, or may have
amendments, in relation to soya, pesticide and hormone
residues, some alleged food violations in the United
States, some employment violations. They have, or may
have, an application to strike out some part of the claim
in relation to nutrition. There is an argument about an
       allegedly privileged document.

Those are matters of substance, but, beyond that, one would
go on with the evidence, we to complete our employment
evidence, which we have not quite done. Then there are
unfinished witnesses of various kinds, and, my Lord, we
will want, if we can get it a good time before the
beginning of next term, a schedule of the Defendants'
employment witnesses as well. I really do not know how
your Lordship would care to deal with it.

There is one other matter which I should attend to now --
I will mention it in case I forget -- Mr. Morris mentioned
the other day that he had the transcripts of the uncut
interviews of "One Every Mile". We should like to have
that, please, or have those, please, by way of discovery.
We will obviously make a copy ourselves.
