Day 162 - 25 Jul 95 - Page 17

       well.

MS. STEEL: I think that was on the list that Mr. Rampton --
       maybe it was not.

  MR. JUSTICE BELL: Sorry?

MS. STEEL: I just said that I thought that was on the list but
then I said maybe it was not, but I was -----

MR. JUSTICE BELL: It may well be, but I am putting it in my
notebook as well. It was on the list because you had a
schedule of those who wanted to be recalled and possibles.

MR. MORRIS: Yes. So there is the outstanding one to five,
anything that was not dealt with, the child labour
violations and the food hygiene violations and nutrition
strike out application. As far as the schedule of our
       witnesses -----

MR. JUSTICE BELL: Let us think about timing. Take it step by
step. How long is it going to take to argue that?

MR. MORRIS: Are we due to come back on -----

MR. JUSTICE BELL: Monday, 25th September.

MR. MORRIS: Monday, 25th. I think a couple of days might be a
good estimate. It might be slightly -----

MR. JUSTICE BELL: What I would suggest, in fact, we allow
Monday, Tuesday and Wednesday for those matters.

MR. RAMPTON: Yes. My Lord, in that case we will get a witness
       ready for Thursday, 28th.

MR. JUSTICE BELL: What I suggest is that you produce, or
Mrs. Brindley-Codd (if she would be so kind) produce one of
her schedules to get us going next term, at least up to the
end of employment witnesses and Mr. Fairgrieve, if you
choose to put him in there.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: That should be done as soon as possible with
a view to Ms. Steel and Mr. Morris then putting in your
       employment witnesses.

MR. MORRIS: So once we have a schedule from the Plaintiffs for
       their outstanding witnesses -----

MR. JUSTICE BELL: Their outstanding employment -----

MR. MORRIS: Employment and Mr. Fairgrieve, if they choose, then
we can respond by starting to compile a schedule of our own
       witnesses.

MR. RAMPTON: We will do that very soon, my Lord, because we
have only got about three or four left anyway. It will not
       take very long.
