Day 163 - 25 Sep 95 - Page 19

MR. MORRIS: All right. Jerome Avenue. The first reference to
Jerome Avenue is on page 2 at the bottom, New York Times,
January 24th, 1988, which, if you look in the middle of the
page, it talks about, "nine restaurants were allowed to
reopen after correcting earlier violations" and one that
was closed for having failed to do so. The establishments
are these, under "Violations", it says: "McDonald's 2065,
Jerome Avenue." That is why I have put "it is believed
allowed to reopen when corrected" because the person who
sent us this had put "probably allowed to reopen". I think
that is based upon the fact that it is in that section of
the stores that were allowed to reopen after correcting
earlier violations.

There is another reference to Jerome Avenue which is over
the page, also January 24th, 1988, the News Day, Sunday,
City edition. This refers to the same Jerome Avenue.
I think that deals with Jerome Avenue.

Shall we move on to Southern Boulevard?

MR. JUSTICE BELL: Yes.

MR. MORRIS: Southern Boulevard. That is in the middle of
page 4. It is the second one of a group of three
McDonald's ---

MR. JUSTICE BELL: Yes.

MR. MORRIS: -- which, if you look a bit further up, this is a
report in the New York Times, late City final edition,
January 10th, 1988. Then it says under the word
"Headline", "New York City Department of Health last week
released a list of 21 food establishments cited for
violating the health code". Then it lists McDonald's 2505
Southern Boulevard. It has in brackets "(189th Street)".
It says: "No chemical kit" as the particular violation.
I want to check if there is another reference to that one.
Actually, I -----

MR. JUSTICE BELL: That is January 1988 and your proposed
amendment suggests there is another in about November 1987.

MR. MORRIS: Right, yes, sorry. I have actually made a mistake
here. That second sentence, "... and for operating without
a valid permit, flies, no vacuum breaker and other matters
in and around November 1987". If you look on page 5, at
the bottom of page 5, of the document, it is actually a
reference to 2065 Jerome Avenue. I think that is a
typographical error. It should have gone in the particular
No. 3.

MR. JUSTICE BELL: So you want to move that up?

MR. MORRIS: Yes, I am sorry about that.

MR. JUSTICE BELL: Yes.

MR. MORRIS: OK. The next one is, if we go back to page 4, the
