Day 163 - 25 Sep 95 - Page 20

third one of that group of three McDonald's in the centre
of that page, 1540 Westchester Avenue, Boynton Avenue, New
York, "mouse droppings, material on floor, water stains on
wall and ceiling in or around January 1988". January 10th,
1980 is when this was reported.

Then the next one is on page 5 of the document. It is
particular No. 6 on page 5 of the document under
"Violations", Manhattan McDonald's 40 to 18 Main Street.
Why it is 40 to 18, I do not know; whether that is a
misprint for 40 to 48. But, anyway, we have put down to 40
to 18 Main Street, New York, cited for violations.

I think that is the only reference to that one. Then the
last one in this particular series is to be found on page 6
of the document. It is the penultimate paragraph on page
       6. Again, if we look for the date, we can see that it is
from the New York Times of October 25th, 1987. It is
McDonald's 982, Southern Boulevard, "flies in basement".

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Those, obviously, are printouts relevant to the New
York Times and the New York area for a very particular
short period of time. So, it is a snapshot of the
problem. If we just look for completeness, on page 8 we
have the third paragraph from the bottom: "McDonald's
restaurant at 76 Brainard Road". I have not really
identified this. This is really an explanation of how a
number of stores were closed on inspection and then they
were later re-inspected and with improved scores.

I am just trying to find the paragraph which explains.
Yes. The very first paragraph on page 7 explains that
these were Hertford restaurants that failed a random State
health inspection in January, presumably, January 1994, and
have since been found to comply with minimum health
       requirements.

Then in the next paragraph it says: "After a series of
re-inspections completed this week", that would have been
in March, presumably, 1994, "most of the Health Code
violations had been corrected." On page 8, on that third
paragraph from the bottom, basically it says that
McDonald's is one of the stores that passed the
       re-inspection.

I have called that particular 8, if that is any help?

  MR. JUSTICE BELL: Yes.

MR. MORRIS: Then we have particular 9 -- I have not photocopied
this. Actually, particular 9, it was a separate document,
so maybe if I could probably leave that one until tomorrow?

  MR. JUSTICE BELL: Yes.

MR. MORRIS: It is from a separate document. It is actually a
photocopy of the New York Times, I think. I will try to
bring that in tomorrow. Shall I move on to the child
