Day 163 - 25 Sep 95 - Page 28
7 o'clock, involving 28 minors.

It does give a helpful summary of what the law is in the
second to last paragraph on that page about the provisions
in the Fair Labour Standards Act in the States. The
franchisee was Kiercon Limited. Violations occurred
between December 1992 and December 1994.

The next one is paragraph (6): "In Fair Lawn, New Jersey,
in or before December 1994 a McDonald's store was found in
violation of the child labour laws in respect of a 14 year
old, resulting in a fine of $900". Then also in Trenton,
New Jersey, around the same time in respect of 25
employees, McDonald's being fined $10,200. If we look at
page 15 -- I think they are both on page 15 -- in the
middle of the page under the words: "The Record, December
7th 1994", "McDonald's in Fair Lawn was find $900 for
overworking a 14 year old."

MR. JUSTICE BELL: The other one?

MR. MORRIS: The other one, Trenton, is at the bottom of the
page, the big paragraph at the bottom. It talks about some
of the biggest fines. I think if we look at the page
before, 14, it talks about a Labour Department
investigation, specific investigation, in the first
paragraph of the report. Then among the biggest fines, on
page 15 at the bottom: "McDonald's in Trenton for hour
violations involving 25 employees, fined $10,200."

MR. JUSTICE BELL: Yes.

MR. MORRIS: The next page, page 16, USA Today, April 5th 1993,
reported about Sioux Falls, saying that McDonald's will
appeal federal fines for child labour law violations: "A
US Labour Department fined the chain for labour violations
involving 179 minors at the Corporation's five local
locations". It does say Tennessee at the end there, but
I think that is a -----

MR. JUSTICE BELL: You say that -- you put Tennessee to
Mr. Stein?

MR. MORRIS: Have I put Tennessee?

MR. JUSTICE BELL: But I suggested that there is a Sioux Falls
in either North or South Dakota because I once went through
it.

MR. RAMPTON: My Lord, I think Tennessee goes with Nashville.

MR. JUSTICE BELL: And Tennessee, I would have thought, as
Mr. Rampton says, goes with Nashville on the next line. So
anyway -----

MR. MORRIS: We will assume it is South Dakota.

MR. JUSTICE BELL: We have moved north west of it. So, South
Dakota, you say?
