5 MR. JUSTICE BELL: What is the position there?

7 MR. RAMPTON: The position there is that the only one of the
8 Defendants' industrial tribunal witnesses that we have so
9 far, at least, been told is coming to court is Logan.
10 Your Lordship will understand that Jane Jarvis and Janette
11 Eady were originally to be called to deal with what was in
12 the industrial tribunal.

14 MR. JUSTICE BELL: Yes. I do not need any explanation, because
15 I could see you might take the view that it is what
16 Mr. Logan alleges after his reinstatement, which is of more
17 potential significance in the case than events leading to
18 his temporary departure in the middle of his service in
19 1991 or 1992. But, in any event, I can cross all those
20 out?

22 MR. RAMPTON: My Lord, yes, at any rate, so far as Jarvis and
23 Eady are concerned, in the form in which your Lordship
24 finds them in the bundle at the moment; that evidence has
25 really become irrelevant.

27 MR. JUSTICE BELL: But does that mean that you might be
28 contemplating calling them for some other reason?

30 MR. RAMPTON: My Lord, I have not yet had the chance to analyse
31 what are the consequences of the recent discussion in the
32 (inaudible) indication your Lordship gave -- no, it is an
33 order now -- in relation to Bath. It may very well be, as
34 I think your Lordship indicated at the time, that either
35 side will want to call additional evidence.

37 MR. JUSTICE BELL: What I will do, I will cross out witnesses
38 Nos. 20 and 21, and 24 to 30.
