4 MS. STEEL: If I could just say, Mr. Rampton said something
5 about this being an artificial exercise; Mr. Morris was
6 going to ask the witness if he could remember when such and
7 such happened, or whether it happened at the time, and that
8 is what he meant by dates and names. It was not that Mr.
9 Morris had a list ready and waiting of dates and names but
10 we have decided not to put it in this after going and
11 speaking to the witness.

13 The second thing is that since it seems to be agreed, and
14 it is certainly our view, that all the matters that are in
15 the pages that have been photocopied and handed to you and
16 McDonald's are matters of elaboration, that there should
17 not have been a problem anyway, because you did say on a
18 previous occasion that you did not expect there would be
19 objection to elaboration. Where it is elaboration, I think
20 that really to ask for full details of that five days in
21 advance is going to be a lot of unnecessary work.

23 We do recognise and we are trying to adhere to the point
24 about new topics or new substantial incidents as opposed to
25 elaboration, but really we do feel that everything we
26 wanted to raise this morning was purely elaboration and,
27 therefore, we assumed it would be allowable.

29 MR. JUSTICE BELL: Yes. Thank you. What I will do is I will
30 return at quarter past 2. I will then give some directions
31 for future procedure with my reasons for so doing, and when
32 I have done that we will go on with Mr. Whittle.
