Day 177 - 26 Oct 95 - Page 06
and Ipswich he went to off and on for some several weeks;
and the point he was going to make was that there was not
much difference; and I think other witnesses have been
asked in the witness box -- quite a lot of them -- if they
have worked at other stores, you know, "Was your experience
roughly the same elsewhere where you have worked for
McDonald's?" We were not going to go into any details of
any kind.

In fact, with Milton Keynes, there was another detail which
I see from my notes that he wanted to say. He said that he
was badly treated at Milton Keynes in his statement.

MR. JUSTICE BELL: Yes. I read that.

MR. MORRIS: He wanted to say that the reason he was badly
treated was that he was expected to work extremely long
hours.

MR. JUSTICE BELL: That is number 3, is it not, on your list?

MR. MORRIS: I am sorry?

MR. JUSTICE BELL: Point 3.

MR. MORRIS: Yes. The Plaintiffs have not complained about that
one. So that is fair enough, then. I am sorry, I thought
I had not put it down.

MR. JUSTICE BELL: What I suggest, unless Mr. Rampton wants to
come back, is that I give you leave to ask Mr. Gibney about
the matters which appear on your sheet, and times and names
as well, if you wish, in relation to Colchester and
Milton Keynes; that rather than you giving written
particulars, if you can get written particulars off him
tomorrow and get them to Mrs. Brinley-Codd, try to do so.

MR. MORRIS: About Clacton and Ipswich?

MR. JUSTICE BELL: No, no, about Colchester and Milton Keynes.
Put Clacton and Ipswich on one side for the moment. Put
them on one side for the moment. We will come back to
them.

MR. MORRIS: I am not bothered about Clacton and Ipswich,
particularly.

MR. JUSTICE BELL: At the moment, I am minded to restrict the
evidence to Colchester and Milton Keynes. I cannot believe
it will make one jot of difference one way or the other,
the other places, anyway, because, as I have said, the way
it looks to me at the moment, if I accept Mr. Gibney's
evidence about Colchester, you have achieved all you could
reasonably expect to achieve from his evidence, and, if I
do not accept it, talking about other restaurants, it will
only be because I do not find him a credible witness
anyway.

So let us stick to Colchester and Milton Keynes. If you
can give names and particulars by Monday, well and good.
