3 MR. MORRIS: (To the witness): Second paragraph. Mr. Holm, who
4 is he? What is his position in McDonald's Norway?

6 MR. JUSTICE BELL: Unless there is some change, he has said he
7 is Managing Director of the McDonald's Norwegian company,
8 which has subsidiaries which run some of the restaurants
9 and subfranchisees which run others.

11 MR. MORRIS: Right. He says: "Firstly, Jenssen is incorrect in
12 asserting that we gave notice to dismiss 12 restaurant
13 closers because they had joined the union. It is true that
14 we gave notice to dismiss 11 restaurant closers from our
15 Oslo restaurants. However, this has nothing whatsoever to
16 do with the trade union. I was not aware which of the
17 closers were union members and which were not."

22 In the next paragraph, he says: "In the summer of 1993 we
23 have been reviewing our use of closers in our Oslo
24 restaurants, principally with regard to the possibility of
25 reducing labour costs but also from the security point of
26 view, because often the closers would work alone,
27 presenting a potential security risk with regard to the
28 money kept in the restaurant. As a result of this, we
29 decided we would purchase dishwashers for the restaurants,
30 thus making the closers" -----

33 someone here who is studying at university who, I would
34 have thought, is probably an intelligent young man who, for
35 all I know, has read this before and, if he has not, can be
36 asked just to read, for instance, paragraphs 2 to 6, which
37 concern the closers to himself, and then merely be asked if
38 there is anything there with which he joins issue, with
39 which he disagrees; and then, if he does disagree with
40 something, you can ask him to tell me about it.
