Day 191 - 24 Nov 95 - Page 08

       unfair dismissal?
       A. I did not know I could.

  Q. Your wife did, did she not, Sarah Baker -- Sarah Dunn, as
she then was -- did she not?
       A. Yes, she did.

  Q. You say you did not know about it?
       A. I did not know about it beforehand and ------

  Q. Did she not tell you about it?
       A. Yes, she told me about it.

  Q. Why did you not do it?
       A. I could not be bothered.

  Q. I see. That is a different answer from the first one, is
it not? "Did not know about it" was what you first said.
       A. The first time, I did not know about it. The only
tribunal that I knew of, you had to be working for a firm
for two years or more, which was a long time. You know,
I had not been working there for long enough, as far as
       I knew.

  Q. But she had been working even less long than you had, had
she not? She started in January; and she succeeded and she
got compensation, did she not? You remember that, do you
       not?
       A. I think so. I am not sure. I do not know if it went
to court or if it was settled out of court. I do not know.

  Q. It was settled; McDonald's paid her money. She made the
complaint, they recognised the court, and they paid her
       money. Do you remember that?
       A. Yes.

  Q. Yes. The reason you did not bring a complaint was that you
knew very well you had been caught red-handed pinching
       meat, is it not?
       A. No.

MR. RAMPTON: My Lord, there is an answer missing from
Caseview. I hope it comes out on the transcript. I asked
the witness whether Mr. Terry Eagle has sorted out the
business of the clock cards, and I think because the
witness nodded, the answer "yes" is missing.

MR. JUSTICE BELL: My note was: "As far as I know, Mr. Eagle was
called in and he sorted it out."

MR. RAMPTON: Yes. Thank you, Mr. Baker.

MR. JUSTICE BELL: (To the witness): How old are you now?
       A. I am 31.

  Q. When is your birthday?
       A. May 5th.

  Q. So you were just about 21 at the time you left?
       A. Yes.
