Day 197 - 07 Dec 95 - Page 28
line". That is November 1988, Tim Taylor.

Then page 9, the next page, yes, I think that page 12 may
relate to that previous audit, PR.

MR. JUSTICE BELL: Do not worry about sorting all that now. If
you have not got things which are obviously in your mind,
leave them and come back to them at some other time. Do
not let Ms. Steel tug your gown too much. She can stand
up and tell me -----

MS. STEEL: If I can just make the point that I think there is
an important thing on page 12 which is that No. 9
says: "All stores to hit maximum yields on shake fry and
drinks consistently".

MR. MORRIS: That was actually dated January 1989 from John
Atherton.

MR. JUSTICE BELL: Yes.

MR. MORRIS: He did the PR on page 9 for March 1989 for Mark
Davis. Then it says in the second paragraph: "You have
set objectives and goals for your Managers although have
not seen them reviewed". Just note that. Various bits
and pieces. We can note the profit section on page 10, it
says: "An excellently" -- this is third line under
"Profit" -- "controlled" -- note the word "controlled" --
"first quarter, the best Supervisors' group in the region
and probably in the country". This is at the time when, I
believe -----

MR. JUSTICE BELL: Do not make comment. What I want to do is
to be able to underline it so I make sure that I read the
bits you are concerned about.

MR. MORRIS: Right, OK. There is a brief complaint 10,
point 4, QSE, first line about problems at Clacton. I
will move on. Then it says at the top of page 11:
"Overall, looking back, you have much to be proud. You
have deservedly won Supervisor of the year and the first
four months of this year have continued in the same
fashion".

Moving on to page 5, this is the PR on Mark Davis,
13th September 1989. The various targets, and over the
payment on page 6 we have his consolidated figures for his
stores.

MR. JUSTICE BELL: Can you remind me which is store 141?

MR. MORRIS: That is Colchester. The later was another
Colchester store which had a different number but that is
the one we are concerned.

MR. JUSTICE BELL: This Colchester is the high street or the
other one, the first one? High street, is it?

MR. RAMPTON: High street -- (inaudible) comes later.
