1 MR. JUSTICE BELL: Mr. Rampton, the statement started off that
2 Miss Watkins inspected and filmed conditions at one of the
3 Sun Valley Poultry Limited private broiler chicken grower
4 sites, and there was no challenge to that, so I can accept
5 that it was one?

7 MR. RAMPTON: Yes, my Lord. It certainly was -- I do not know
8 whether it is one of their own farms. I suspect it was --
9 I will find out for your Lordship if it makes a difference
10 -- one of the contracting farms, but I cannot say that for
11 certain.

13 MR. JUSTICE BELL: Since it says "private broiler chicken grower
14 sites" in Miss Watkins' statement, I have assumed it was a
15 contracted farm, but if you obtain any information that it
16 is, in fact, one of Sun Valley's own, I would be grateful
17 if I could be informed.

19 MR. RAMPTON: In the light of that assumption, I believe I am
20 obliged to find out and tell your Lordship.

22 MR. JUSTICE BELL: Obviously, it might be germane. Then, if it
23 can be agreed what it is, obviously I do not need to hear
24 any further evidence. Yes?

26 MR. RAMPTON: We are in your Lordship's hands as to where we go
27 next, according to the agenda. I can deal with anything
28 your Lordship wishes at the moment.

30 MR. JUSTICE BELL: All I was anticipating -- first of all, there
31 is no need to prolong the day because I have other matters
32 I can usefully attend to for the rest of the day, but
33 I thought we could at least see what the position is with
34 regard to Dr. North's further report. Some discussion
35 might help on the question of further nutrition evidence,
36 even if it is just food for further thought on Friday.
37 I think we could come back to the schedule for next term on
38 Friday, deal with the question of whether all or any of the
39 evidence of Mr. Bateman and Miss Link is relevant to any
40 issue in the proceedings on Friday, canvass any loose ends
41 about Defendants' discovery on Friday and anything else
42 which crops up in the meantime.

44 MR. RAMPTON: Would your Lordship like to get Dr. North out of
45 the way, then I will attend to the question of nutrition,
46 if I may? I can do that before the adjournment.

48 MR. JUSTICE BELL: I think what we will do, I would have thought
49 we could get through the things we have to do comfortably
50 before 1 o'clock, but I will break off at 1 o'clock anyway
51 and call it a day then. What is the position with regard
52 to Dr. North? You explained he was under considerable
53 pressure or you were not having a lot of luck.

55 MR. MORRIS: Yes. I actually spoke to him last night, which was
56 unusual to get hold of him directly. I tied him down and
57 he faxed through a preliminary statement -- very short --
58 this morning on the E.coli and Preston matter. I will have
59 to get back to him to discuss that and any further issue
60 which he was going to be covering.
