Day 201 - 15 Dec 95 - Page 10

and get evidence of my own; so, the sooner the better. But
one has to be realistic. If Mr. North is going to be
working on it next week, then, I do not know, maybe a
fortnight from now we could have it. I do not know. It is
entirely a matter for your Lordship, but I am sure it would
help if there was a deadline.

MR. JUSTICE BELL: What I suggest is, I direct that any further
report -- before I actually give any direction, do you have
anything to say about the E.coli report?

MR. RAMPTON: Again, I have only just glanced at it. It has
only just been given to me. Two things strike me at first
glance -- and I do not want to make this my final word on
the subject. The first is that it does not really add
anything to what he has already said; secondly, if I were
the tribunal of fact, it would cause some considerable
irritation, because it purports to decide the sort of
       questions -----

MR. JUSTICE BELL: Well, I know. Maybe I am not as easily
irritated as you. Everybody wants to tell the judge how to
do his own job. I am just prepared to ignore that.

MR. RAMPTON: I am grateful. I admire your Lordship's
patience. There is quite a lot in that that has nothing to
       do with expertise at all.

MR. JUSTICE BELL: Subject to that, if in so far as -- it looks
as if Mr. North is going to come back; I will deal with the
other matter first -- that any further report to deal with
the question of pesticide residues should be served by the
Defendants on the Plaintiffs by not later than Friday,
5th January. I am just working out the date. I should put
that behind Mr. North, should I?

  MR. MORRIS: Yes, please.

MR. JUSTICE BELL: Just so that I can clear my own desk a bit,
I have in front of me a letter dated 15th December 1995,
which is addressed to Ms. Steel and looks to me as if it is
the letter about Mr. Fairgrieve's discovery.

MR. RAMPTON: My Lord, that is just for your Lordship's
       correspondence file.

MR. JUSTICE BELL: Where do I put the documents which appear
       behind it?

MR. RAMPTON: I do not know whether those documents are not
already in the file. If they are not, it is yellow file 5,
       which is the nutrition file.

MR. JUSTICE BELL: I will put them somewhere behind
       Mr. Fairgrieve.

MR. RAMPTON: Your Lordship may find, on looking, that a number
of them are already there. I do not know. (Pause) It is
       tab 3, my Lord.
