Day 205 - 17 Jan 96 - Page 04

any extra hours I did and a taxi home was never provided.
I regularly witnessed girls under 18 working past
10.00 p.m. and boys under 18 working past midnight. This
can be proved by the clock cards. Some of the people
I remember are Simon Warr, Adrian Brett, Ryan George,
Tim Simpson, Simon Gibney, Martin Braithwaite,
       Tracy Milleine and Mandy Docherty."

How do you know tht all those people worked past their
       legal hours?
       A. Because I was working with them.

  Q. You were working with those people?
       A. Yes.

  Q. I continue to read.

"I also witnessed people suffering serious burns and being
dissuaded from taking any action. I remember Vicky Golding
being badly burnt and going to hospital. On one occasion
I remember the management locking the crew room to the crew
because it was being left untidy.

"Myself and some other crew members formed the McDonald's
Freedom Fighters. This was a joke between all of us, but
the management took it seriously and the five supposed
ringleaders, myself included, were taken to the training
room and warned by the Assistant Manager, Mark Davis,
that 'the joke had gone too far, it must stop or there will
       be trouble'."

Does that summarise your true experiences at McDonald's?
       A. Yes.

  Q. And it stands as your evidence today?
       A. That is right.

  MR. MORRIS: No further questions.

                   Cross-examined by MR. RAMPTON

MR. RAMPTON: Only one question, Mr. Shafibeik -- sorry, two
questions. When you first worked at McDonald's, the
Manager was a Mr. Martin Holloway; is that right?
       A. I am not clear. I mainly remember Mark Davis.

  Q. That must have been your second period that you worked
under Mark Davis; do you agree?
       A.  When Mark Davis was there first time and second time;
the first time he actually interviewed me for the job.

  Q. You say in your statement, you see, that during the
McDonald's Freedom Fighters incident, Mark Davis was First
       Assistant?
       A. Yes, that is how I remember it.

  Q. Yes, thank you. Can you remember the names of any people
who forced you to stay on later than you had thought you
       were going to work?
       A. Yes, yes, all the management.
