     2        not play any part, so far as one can see, in the case, then
     3        for all those reasons, given the references in the
     4        transcripts as they are cited, it does not seem to us to
     5        take things much further and, therefore, it would be a
     6        waste of time were it to be heard.

     8        What I can do, your Lordship, if you wanted, I can give
     9        you, as I say, a complete list of references.  I have given
    10        you almost all of them anyway, but I can give them to you
    11        now if you want them.  It will not take more than a minute.

    13   MR. JUSTICE BELL:  I suggest you give them to me.

    15   MR. ATKINSON:  Yes.  The references are -- I will just hand them
    16        up to your Lordship, to save time.

    20   MR. JUSTICE BELL:  Let me just see how many there are, first of
    21        all.  I will take a copy of that.  Can we just make a
    22        couple of copies for Ms. Steel and Mr. Morris?

    24   MR. ATKINSON:  My Lord, there is just one further reference on
    25        page 61 of day 38, which is a summary point, I think, where
    26        your Lordship says:  "I think you should go on with the
    27        evidence in the morning, but when Dr. Millstone has
    28        finished giving his evidence and has finished being
    29        cross-examined, all I am saying is that I am not, subject
    30        to any argument from Mr. Rampton, shutting the door if
    31        Dr. Millstone gives you further information which enables
    32        you to point to some harder evidence that he may have given
    33        as to the frequency and incidence of these adverse
    34        reactions which he is not able to do by his own admission.
    35        There is no criticism of him at all, in that regard at any
    36        rate."

    38   MR. JUSTICE BELL:  Thank you, Mr. Atkinson.  What do you want to
    39        say about that?  Do you want to speak in answer to
    40        Mr. Atkinson now?

    45        of further references.

    48        was, but I might as well put our case.

    52   MR. MORRIS:  If there are any problems, if there is any 
    53        difficulty in a judgment on the matter, it may be that it
    54        can be left over to check the references, or whatever.

    56        First of all, I believe Dr. Millstone has kindly done the
    57        statement which had been indicated he should do or he could
    58        do, and it would help the court, and I think that should be
    59        taken into consideration.  It is a statement that would
    60        help the court, so it should be allowed.
