Day 206 - 22 Jan 96 - Page 10

The case of the Plaintiffs seems to be -- actually, if
I can just point out that the last reference of
Mr. Atkinson, page 61, line 9, on 19th October,
was: ".....given harder evidence that he may have given as
to the frequency and incidence of these adverse reactions",
the point being that in some of the statements
Dr. Millstone deals with the reactions.

MR. JUSTICE BELL: Point that out to me.

MR. MORRIS: I mean, what I am saying is if -----

MR. JUSTICE BELL: Which part of the statement?

MR. MORRIS: Yes. I mean, I have not had time to look through
it, but on an immediate looking at it, for example, on
page 10, the second paragraph, first full paragraph -----

MR. JUSTICE BELL: Yes.

MR. MORRIS: First full paragraph on page 10: "....thirteen
separate studies on the effects of dietary change of people
suffering with urticaria, he found clear improvements in
the conditions of between 62% and 92% of the patients...."
The point being there, he is looking at the reaction and
then that is part of his scientific review of the whole
situation. In other words, it is not just a question of
forcefeeding patients with a certain additive and then
seeing what the reaction is; it is also looking at the
analysis of medical histories of patients and response to
treatment on one of the reactions which he has identified
previously as being a problem with specific additives. So,
that is one way of looking at the situations.

If we look on page 3, he has done the same thing in the
last paragraph on page 3, the third line down: "Similarly,
Supramaniam and Warner reported that 56% of children with
angio-oedema and/or urticaria reacted to challenge with
food additives including food colours." So, he is looking
at the reactions, angio-oedema as well as urticaria, in
that case.

This is just something I have seen, you know, in a quick
flick through the statement, which I have not read for
about a week. That seems to be doing what was being asked
of him.

In another respect, he has made quite a responsible --
well, extremely responsible -- scientific analysis of the
information that exists on the subject.

MR. JUSTICE BELL: No one at this stage is criticising his
further report. It is just a question of whether it has
really dealt with the loose end which I was concerned about
and, therefore, whether it is going to help me.

MR. MORRIS: Well, it does. He goes into more depth, he goes
into more detail, he provides further studies, and he comes
up with conclusions throughout which are more profound
