Day 206 - 22 Jan 96 - Page 18

is running out now in this case. We are hopeful, even with
a recall of Dr. North, we shall finish the evidence, all
the evidence, some time in the early part of May. There is
a space -- I know Dr. North is a busy man and I know the
Defendants are not always able to get hold of him as
readily as we should like, perhaps as they should like --
in the schedule, according to our calculations, towards the
end of March, from 18th through to -- I think term ends on
       3rd April.

That is the time at which we were proposing, subject always
to what happens beforehand and to your Lordship's
management of the case, to recall or re-enter the field of
nutrition and we included Mr. Fairgrieve and whoever else
in that category. It would, perhaps, your Lordship might
think, be convenient to say now that Dr. North should come
back at some time from 18th March, between 18th March and
3rd April, which is two and a half weeks.

MR. JUSTICE BELL: On what you have just said, that would seem
to be convenient. What I will say, Ms. Steel and
Mr. Morris, is I would like you to make contact with
Dr. North as soon as possible and see if you can arrange
those dates. If they are impossible, then come up with
       some other suggestions.

Granting leave to recall any witness is all on the premise
that they can actually come before the evidence in the case
       is closed.

MR. MORRIS: Can I just say, while we are on that subject, that
we are trying to call witnesses for the 25th and 26th
       March.

MR. JUSTICE BELL: Look, I am going to break there for five
minutes for this reason, that on Wednesday evening neither
Mr. Glen nor I could find my copy of the timetable which
has just gone astray somewhere. It will be tucked away in
       a bundle somewhere.

MR. RAMPTON: I will give your Lordship -----

MR. JUSTICE BELL: I wonder, if I rise, take our five minute
break now and have a photocopy made in the meantime.

MR. RAMPTON: We have lots of spares. Your Lordship is welcome
       to keep that.

MR. JUSTICE BELL: Right, thank you.

MR. RAMPTON: I am not sure that that particular version goes as
far as the beginning of April. I think it ends at
       29th March.

MR. JUSTICE BELL: You were suggesting Dr. North on 18th and/or
       19th March?

MR. RAMPTON: Something like that, my Lord, yes, which is
presently blanked out but so as to give the Defendants time
to prepare for nutrition, further nutrition, evidence. But
