Day 206 - 22 Jan 96 - Page 19

one notices that your Lordship is away anyway on the 13th
       and 14th.

MR. JUSTICE BELL: They are the 14th and 15th. I meant to point
that out. The dates are the 14th and 15th and I can sit on
       the morning of Thursday, 14th.

  MR. RAMPTON: Excellent.

MR. JUSTICE BELL: So, it is the afternoon of the 14th and the
whole of the 15th which should be crossed out. I will take
the five minute break there in any event.

                      (Short adjournment)

MR. MORRIS: Can I just go back a bit? Are we still dealing
with the schedule or can we deal with that later on at some
       time?

MR. JUSTICE BELL: No, we were only dealing with the schedule,
as I understood it, because I gave leave for you to recall
Dr. North which prompted Mr. Rampton to look for dates when
it might be convenient to recall him.

MR. MORRIS: Right. I have a summary -----

MR. JUSTICE BELL: What is the point you are -----

MR. MORRIS: The point I was going to make is that, if I can
find it, there was a pleading on the whole issue of
residues, pesticides, and that pleading, the granting the
amendment, was left over until we sorted out.

MR. JUSTICE BELL: Have you actually got it with you now?

MR. MORRIS: I cannot find it.

MR. JUSTICE BELL: Look, can I make a suggestion? Find it at
your in your own time, but now you have actually got
Dr. North's new report, give a bit of thought to the way it
is expressed because I do not know whether you still want
your amendment in the form you were considering then or in
       some other form.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: Presumably, when you drafted that you did not
have Dr. North's new report on pesticide residues?

MR. MORRIS: That is correct. We were prepared to argue it at
that time on the grounds the evidence had already been in
the case, but you just felt it was better to wait.

MR. JUSTICE BELL: All I am suggesting is that you have another
look at it in the light of the fact that you expect
Dr. North to give evidence in accordance with his recent
       report.

MR. MORRIS: Sorry, I am just trying to sort out my papers.
Just on the last subject of the schedule, just to say again
