Day 206 - 22 Jan 96 - Page 29

  MR. MORRIS: Yes.

MR. JUSTICE BELL: -- the extra from either the written
       statement or the transcript?

MR. MORRIS: Yes. The transcript of his evidence -- shall I go
through what I think are the most significant parts?

MR. JUSTICE BELL: You need not bother about 1 and 3 ---

  MR. MORRIS: OK.

MR. JUSTICE BELL: -- because I propose to give you leave for
those. I give you leave for 2 if you can point at
something which tends to support it.

MR. MORRIS: Yes, can I just say ------

MR. JUSTICE BELL: But I think you ought to have that. There is
no point in having it in if you cannot find it.

MR. MORRIS: No, I will. Can I just point out in point 1 that
Mr. Rampton says I should put "alleged" violations.

MR. JUSTICE BELL: Do not worry about that because what
I understand you to say -- it is an argument which may not
succeed at the end of the day; I have not thought
sufficiently about it yet -- that if there is a citation
there probably was a violation. Whether that argument will
succeed or not, we will have to see.

MR. MORRIS: Yes. Can I just say though that it may be worth
       looking at page 234 ---

  MR. JUSTICE BELL: Yes.

MR. MORRIS: -- Mr. Stein in his written statement to the
Congress Committee says just before the words "McDonald's
workforce": "The majority of these violations were
primarily hour related, so we would say he accepts that
they are violations, or he ought to -- he is a lawyer. He
understands the situation. So, just quoting him really.

Part 2, paragraph 2, it is really the bottom of page 222
and the top of page 223. Yes, it is the bottom of page --
actually, if you are still on page 234, it may be worth
noticing that at the top of page 234 he does say: "Our
review of the reports of recent enforcement sweeps
indicates that very few of our Company operated restaurants
received any violation notices", so some clearly had.

Then at the bottom of page 222, remembering that in the
middle of that page Mr. Stein says in the middle of the
page: "I am pleased to say that, to my knowledge,
McDonald's Corporation has never been cited for child
labour violations in any restaurant it has operated". That
is challenged by Mr. Lantus. Then at the bottom of the
page Mr. Stein distinguishes between federal and state
       matters.
