Day 206 - 22 Jan 96 - Page 41

MR. MORRIS: Yes. I do not want the situation to arise where
I have not put some documents to their witnesses and then
when it comes to Mr. Logan and I refer him to say, for
example, store audit reports, Mr. Rampton gets up and
says: "You cannot put it to Mr. Logan, because you did not
put it to Mr. Henden", or -----

MR. JUSTICE BELL: All I can say is, when you do begin to
cross-examine, start by putting where you think a document
contradicts what the witness has said, put the document,
and we will see how we go and clear the air about it.

MR. RAMPTON: Before I call Mr. Henden, I was handed -- as
I believe your Lordship must have been -- this morning, yet
further details, apparently derived from Mr. Logan, in note
form by Mr. Morris, expanding an allegation about altering
people's clock cards or altering their hours. That is an
allegation which was put to Mr. Richards without any need
to ask, and your Lordship may hear some argument about
that, where your Lordship actually stopped Mr. Morris going
on with it. But there are other things, including
expansion of that allegation in items 2 to 6, which have
never been alleged before; and, because I only got them
this morning, it is natural that they are not responded to
in the written statements of our witnesses. With
your Lordship's permission, I would propose to ask
Mr. Hendon to comment on the new allegations by Mr. Logan,
because I know that he can now.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: If that is all right, I will do that.

MR. JUSTICE BELL: There is no objection to that, is there,
       Mr. Morris?

  MR. MORRIS: No.

MR. RAMPTON: Mr. Henden, could you go into the witness box over
       there, please.

                           MR. HENDEN, sworn
                        Examined by MR. RAMPTON Q.C.

MR. RAMPTON: Mr. Henden, could you please find in the shelves
behind you -- I am afraid I do not know which volume it is.

  MR. JUSTICE BELL: Yellow XB

MR. RAMPTON: It is a yellow backed file.

MR. JUSTICE BELL: Halfway down, in the middle.

MR. RAMPTON: It has X and B on it. What tab is it?

  MR. JUSTICE BELL: 39H

MR. RAMPTON: I am grateful to your Lordship.

  MR. JUSTICE BELL: Sorry, 39I.
