Day 207 - 23 Jan 96 - Page 07

MR. JUSTICE BELL: -- rather than give firsthand evidence. You
have to try to distinguish between the two. There is
obviously a bit of grey area somewhere in the middle, and
we will see how we do when we come to Mr. Logan. I only
intervened at this stage because I would like you to make a
mental note (preferably an actual written one) that as they
come to you when you are reading documents like this, make
a note somewhere, tab 9, page 167, reference to working
close when under 18 and No. 3 as well, if you want.

MR. MORRIS: Yes. What I will do is I think I will just go
through it quickly and see if the witness knows anything
about it.
(To the witness): If you just go to 179, you will notice
in the middle of the page, Adjustment Audit Report, under
"Hours of work regulations", "excessive entries and
management crew signatures". Should the crew sign the
Adjustment Audit Reports?
A. I believe so.

Q. Right. It seems you only got five out of 20 for that.
Does that indicate that things were not being done
properly?
A. Well, it does not contain any -- there is an asterisk
at the bottom of the page, I think, explains.

Q. Yes. "A lot of entries on night shift; no signatures at
all", not even management then?
A. So .....

Q. It was not being done properly at that time?
A. As the audit indicates, I think.

Q. Right, OK. While we are on that page, you were in charge
of schedules at this time, were you? This is actually
18th February 1994, this series of documents, starting at
171, adjustment -- do you know why you got nought out of 30
for schedules on that page, 179?
A. Well, in brackets, it says, "to include Sundays works
breaks due and total hours for employees". So, I can only
-- as I did not actually carry out the audit, I can only
presume it is because of those things there not being
carried out properly, but I do not actually know, so .....

Q. Were you not talked to about this audit; they said: "Well,
you have got nought out of 30. Buck your ideas up", or
something like that?
A. I do not remember being talked to about it.

Q. You did not get any disciplinary action against you, or
anything like that?
A. Not so far as I know.

Q. Or advice on how to do things properly?
A. As I say, I do not remember anybody giving me any
advice.

Q. Right. Just going back to 167, it says, "Paul Evans worked
a close and is still under 18 years" -- that should be even
