Day 243 - 02 May 96 - Page 26

I will, if I recall Dr. Arnott, ask him about that,
certainly, if he is willing to deal with it.

MS. STEEL: I mean, we would like a statement of what
Dr. Arnott is going to say particularly in relation to
       that.

MR. RAMPTON: Yes, I do not need Ms. Steel's help about that
       either.

MS. STEEL: You have not said that you are going to get
       statements.

MR. JUSTICE BELL: What about Mr. Fairgrieve because he is the
one witness among all these in relation to whom it cannot
be said that it depends on getting information from any
other witness before he is called.

MR. RAMPTON: No. I know that he can do 6th and 7th June, so if
I had Naismith and Arnott for the 20th, 21st, 22nd May,
23rd and 24th are blank anyway because of Mr. Morris' case
in the County Court, then there is nothing until June 4th
which is, as far as I know at the moment, Professor
Campbell. If he starts prompt at 10.30, I do not think it
is likely, my Lord, that he will go through into the
Wednesday, but he might, but I know that Mr. Fairgrieve can
       do 6th or 7th June.

MR. JUSTICE BELL: I think he should be put in for both.

MR. RAMPTON: That leaves only, so far as we are concerned,
Denise Pearce who is not any longer (indeed, has not been
for many years) a McDonald's person. We have to find out
       her availability.

MR. JUSTICE BELL: Can you remind me about her?

MR. RAMPTON: She is the lady who used to do the wages at
McDonald's, to put it in a colloquial way, and she is the
one that saw the Wages Inspector, Mr. Mills, back in 1987,
I think it was, or 86.

MR. MORRIS: Can we -- it is all right.

MR. RAMPTON: I will tell your Lordship what her availability is
when I know it. I see at the moment that there are
possibilities on Tuesday, 14th May and Friday, 17th May,
amongst others. Your Lordship said (and I
respectfully agree) that one does not want anybody on
Wednesday, 8th, though it is a blank.

  MR. JUSTICE BELL: No.

MR. RAMPTON: The first available days would be Tuesday, 14th
       and Friday, 17th.

MS. STEEL: For Pearce, this is?

MR. RAMPTON: This is for Pearce; alternatively, some time in
the week beginning the 10th, or whenever really, because
