Day 243 - 02 May 96 - Page 25

might put to Professor Naismith, apart from any matters
       which you thought of yourself.

MS. STEEL: OK. I do not think I have got anything else.

MR. JUSTICE BELL: Do you have anything to say about that,
       Mr. Rampton?

MR. RAMPTON: No, I do not at all. I was going to try to fit my
witnesses in as and when dates are available. I will give
your Lordship some suggestions in a moment, if I may? I
would only say this additional thing in relation to
Professor Crawford: Your Lordship indicated in the ruling
you made the other day that if his evidence is going to be
extended, his evidence-in-chief, then that should be put in
writing and disclosed to us before he comes. It is another
reason for getting the stuff to him sooner rather than
later in case he wants to do that; if he does not want to
       add anything -----

MS. STEEL: We do not need Mr. Rampton to tell us all that.

MR. RAMPTON: If he does not need any additional
       evidence ------

MR. JUSTICE BELL: I will wait and see what happens about that.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: What is the situation at the moment so far as
Monday, 20th to Wednesday, 22nd May is concerned?

MR. RAMPTON: My Lord, at the moment I have got Professor
Naismith lined up for 20th. I doubt he will go into the
21st, but he has that as well, if need be. I am trying to
get Dr. Arnott for the 22nd.

MR. JUSTICE BELL: I would say that one thing, and I cannot
remember, but I think Professor Crawford was called after
Dr. Arnott and Dr. Arnott did not come back in any way ---

  MR. RAMPTON: That is right.

MR. JUSTICE BELL: -- one of the things which might help me is
anything Dr. Arnott had to say about Professor Crawford's
-- I cannot remember whether he dealt with this when he
was in the witness box himself or whether Professor
Crawford's subsequent statement came after Dr. Arnott had
given evidence -- theory of the common denominator between
heart disease and cancer and the unhealthy endothelia.

MR. RAMPTON: My Lord, I remember that.

MR. JUSTICE BELL: There we are. If Dr. Arnott does come back,
I might ask him about that myself, but you obviously may or
       either of the Defendants may.

MR. RAMPTON: It did, my Lord, come after Dr. Arnott had
finished his evidence and, of course, in those
circumstances, I was not in a position to deal with it.
