Day 243 - 02 May 96 - Page 24

Crawford's availability for the required amount of time is
being affected by the availability of Mr. Olive or not.

MR. MORRIS: We can reschedule him first.

MR. JUSTICE BELL: So, which was the first day you were
suggesting for Professor Crawford -- the 18th?

MS. STEEL: 18th June which is a Tuesday. Jane Brophy on
       20th.

MR. JUSTICE BELL: Have you sent Professor Naismith's statement
       to -----

MS. STEEL: I have got copies made and I am intending to get the
letters written and certainly out -----

MR. JUSTICE BELL: What I suggest you do, I said something to
the effect, suggested, that you send the whole statement,
but direct his attention particularly to the parts which
       relate to heart disease.

  MS. STEEL: Yes.

MR. JUSTICE BELL: I will add to that that you should tell him
that there may be some more evidence on updating diet and
cancer, whether or not Dr. Arnott comes back for that. You
have some indication of what some of the developments may
be from Professor Naismith's statement. So, I would
suggest that you ask Professor Crawford to look at that,
even though I have not given leave for Professor Naismith
       to give evidence about it.

MS. STEEL: Yes, I mean, I did actually mention that to both
the witnesses when I spoke to them. They said that, as far
as they are aware, the only things that have come out are
       industry things and -----

MR. JUSTICE BELL: That is entirely a matter for them.

MS. STEEL: They do not consider the position has changed.

MR. JUSTICE BELL: I am just adding to what I said before.

MS. STEEL: I think that that is .....

MR. JUSTICE BELL: The reason I asked the question whether you
have sent Professor Naismith, is that you have to do your
best to communicate with Professor Crawford about that
against the possibility that Professor Naismith gives his
evidence before Mr. Crawford is back.

MS. STEEL: We want him to be heard before Mr. -----

MR. JUSTICE BELL: Yes, if you need to get instructions from, or
if you need to ask Professor Crawford about -----

MS. STEEL: To get advice on what to ask him?

MR. JUSTICE BELL: Yes, or get him to help you as to what you
